@Dan K. I fight this fight often. Thank God you are in Texas.
#1 the dog is never approved a ESA animal, the person is, that's your first clue
ESA dogs are for people with a real Mental illness and can not function with out them. Some people truly do deserve the right to have one. That said. If there is no clear apparent indicator your tent is on the verge of being committed to a the coo-coo's nest, then require a letter from a licence health provider that actually seen this abusive jerk in person. That policy has yet to fail any landlord I ever heard of.
The Texas STATE website basically says those certificates off the internet are scams.
What makes it hard for me, I have rentals near a state funded university that will foolishly accept those scam letters to allow pit bulls in the dorms. Then when those kids get older, they move out of the dorms with their big lie and run in to me. It does not work. I will accept ESA animals if it is real the Mccoy but I stand up and fight back.. so should you.. so should everyone reading this. Enough is enough

@Boone Tyson in the heart of 78539 (Edinburg) is our prime 10 acres on Business HW 281. I might be able to get my group to take $2.50 a foot to sell it. Where else can someone buy prime bankable actionable commercial property so cheap? That kind of property even on the outskirts of Houston is usually closer to $10 a foot. The valley is the land of Gold for developers

OK my construction people have been super easy to find. Contracting has never been easier. so nit every sector. Finding people, who really understand AP, AR and already understand the software that go with it, is a little tough right now. Think some one would have some kind of appreciation of the opportunity for career advancement.

(North of Houston) When I ran employment ads with the word "bookkeeper"I would get hammered with resumes back when we were 5%. Not so much anymore
Right now, I got an ad running to find somebody (kind of clerical) to write leases, manage documents, help post bills and post payments or really just take some of the load off my current staff. No real applicants, the only ones I got were marginally literate people who worked in restaurants looking for new work and that would have to be watched and trained move by move. So 10% unemployment?? hmm.. what ever they want to tell you,they will tell you.

All policies are different. Try to read and compare 2 policies. Word by word its completely impossible (and makes my eyes water). Plus a policy (I think) allowing animals takes on more risk thus more premium so..?
I would very much like to know what ever case in court you are referring to where any judge rules that? I thank you in advance. That is extremely good information.

@Mindy Jensen its a good point, and something I thought about. However, I have to disagree that a tenant can be able to dictate who my trusted brand of insurance is going to be. I would however, allow the tenant to pay the difference in premium to modify the same policy and accommodate in that way.
Anyone with an ESA animal is by definition mentally ill. We should all try to help people with those challenges but not at our expense, its their illness so it is at their expense, not ours.

First let me say to you @Horacio Gutierrez if you can't beat them join them, accept pets always and get paid for or you will try to have them get an ESA dog for free
I read this many times plus its on my State 's website: if there is no apparent need for the ESA dog, you can absolutely ask for proof.. When that happens, I explain to them : My favorite choice of words are: I did not detect any obvious need you had any obvious mental illness that would qualify needing an emotional support dog. Fast forward, it ends up with them paying a security deposit, pet clean fee and $20 more dollars a month, just like anybody else with a dog. However, it would of been wiser if I just upped the rent (market as pet friendly) while on the market and charged all the above, (and rented it faster for taking pets)
I got a apartment complex, I have to go the extra mile for all my tenants and stand up for them too. I did pay for legal advice before it ever happened and was prepared because I know it was going to happen and happen a lot . I am trained by my the lawyer how and what to say and never ever deviate how he directs me. It is walking a tight rope every time, that for sure. Don't like doing that dance it at all
as you can see, my motives are a little different, if its just your one house, then I would not fool with it, just allow it to happen for the amount its worth. When they move out, have some money saved up to rip out the carpet and put tile with 4 coats of high gloss sealer

I am telling you what we do in Texas. My strategy may not apply to California. (its been a while but..in Texas) I can go to the JP with out a lawyer and show the judge my TAA promulgated lease (Texas Apartment Association) no jury, no lawyers unless they hire one. The lease I have? I am sure is tried and tested so if I have to hire a lawyer, its not nearly a costly for me (it will cost but not protracted litigation with endless motions) . I would indeed evict and sue that tenant. Torpedo his credit minimum with a judgment.
I am glad landlords are not seen as "evil" here as they are there. If I lived there, I doubt I would ever try to be in the landlord business, may be I would of gone to law school instead.
