@Caroline Gerardo I have photos of the deck being there, proof from his Facebook offering it for sale, and photos of it no being there anymore. Think that helps?

@Andrew S. appreciate your reply! I have tried this and he doesnt care about the deposit. He's been milking the moratorium and plans to do so as long as he can. I'm crossing my fingers we can win in court filing for non monetary reasons.

@Jill F. Thanks for the input! We are allowed to file in the state for non monetary issues so I'm hoping we can still get him out for this. Also hoping the moratorium isnt extended. Thans again!

Hi all!
I posted in another forum but wanted to double up to ensure I can get some feedback. I recently purchased a duplex in PA. We decided to give a 30 day notice to one of the residents as we’d like to renovate the unit to increase our cash flow.
Also, we learned that this tenant tore a huge deck out that was installed last year behind his unit and sold the lumber for money. We gave him a violation notice asking that it was replaced. Obviously it wasn’t so we filed for eviction. This happened on the old owners watch though.. we are still moving forward with our court hearing and hoping it works out. We also gave another violation notice for some debris in his back yard. He has signed the cdc affidavit and is not currently paying. I am requesting no money but rather just want him out of my house.
Any input/experience/opinions on if we have a decent chance in court would be greatly appreciated!
On the other hand, if he isn’t out by the end of his 30 day notice period, can we take him to court for this and be successful?

Hi everyone!
I recently took possession of a duplex in PA. We have a 30 day notice to vacate to one resident just for lease termination because we’d like him to move out so we can renovate. We also have given 2 notices and have no filed for eviction due to him ripping down a huge deck that was installed in the back yard and selling it for money. This apparently happened on the old owners watch though.. we still are trying to evict for this. The tenant also is not paying and have the signed cdc affidavit. I am requesting no money at all and just want him out.
In your opinion/experience, do we stand a decent chance of winning our hearing? We have plenty of proof, notices, etc.

@Shaun Weekes bought the 3 unit with an fha loan exactly one year ago now. Appraised at $250k last year and loan balance is around $232k..
Rents have been raised a total of over $700 a month but I know most appraisers wont use the income approach to determine value so I'm not sure how much the value has risen.

@Shaun Weekes appreciate the reply. Unfortunately I can’t flip it to fha because I have an fha already open. I worked long and hard finding this portfolio lender willing to do the loan I think that’s why I’m so anxious about it making it through
