I, too, have been hit with non-paying customers in my watergarden business. It sucks having to drag them to court just to get a few hundred dollars, but its the principal of it that makes me do it. If they get away with it, they'll keep doing it to other contractors.
My deleading contract requires 1/3 down, 1/3, after exterior work is complete, and 1/3 after the interior is complete. The interior and exterior work can be done in any order, but I won't take a draw until one or the other is done. I will not allow the lead certificate to be issued until I have my final check.
MA law actually states a contractor can only take 1/3 at a time unless there are custom materials that cost more then a third of the project, then the deposit can be large enough to cover those materials.
It seems that whenever a contractor ties up his own money on a project, the homeowner thinks they can extort extra work that wasn't in the original contract by not paying for what was in the contract. I've found that the best way to avoid contractual disputes is to do great work. I've never failed a lead inspection and my customers have never had any difficulty getting their lead cert.

Be careful of the lead laws. According to MA laws, your rentals need to be deleaded and have a lead cert on file.
If you remove the aluminum siding, you're probably exposing lead paint underneath. Whether it's been deleaded or not, I can pretty much guarantee that there's lead paint under that siding.
Just to work on the property in MA, your contractor needs to be RRP certified. If there's been a lead inspection done and it hasn't been deleaded, you need to have it deleaded by a licensed deleader, not someone RRP certified, and get your lead cert before you can do the rest of the work. If it hasn't been inspected yet, you can renovate first using a RRP certified firm, then have a licensed deleader come in and delead it so you can get your lead cert.
If you give me the address, I'll see if it's been deleaded yet. You will need to have it done and get the lead cert before you rent it to a family with kids under 7, and you can't discriminate against that family either, even if it's because you know there's lead paint in there. However, MA does have loan programs that will pay for the deleading and you don't have to repay it until you sell the property. You also get nice tax breaks for getting it done.

I use Anderson Lead Inspections exclusively for all my inspections. (978) 875-3081. He's fair and inexpensive. He inspects, I delead, he reinspects, you get a Lead Cert, simple.
