I was reading in a "prospectus" of a Mutual Fund Passive Investment Fund that they do not go by "The Investment Act of 1940" nor are they subject to SEC oversight. Is this normal? 

Do individual firms that sponsor Passive Multifamily Deals need to go by these rules?

I was recently sent a "prospectus" to a closed Real estate fund. While reading the legal details, I was concerned about the wording that the fund will NOT follow the Investment Company Act of 1940 nor will it be subject to SEC oversight. Should I be worried and run from this firm? (I think I should - but I am new to passive investing)

Do most passive multifamily investment firms go by the Investment Company Act of 1940 and other protections??

Curious to know who has invested with passive investing  firms such as CrowdStreet, Ashcroft, Goodegg etc. How was your experience?

  1. @Jennifer Novak thank you for your input and the example. I had heard of line of credit, but don't understand how they work. Are these just used to purchase, then you have to convert to a different type loan after 12months or so?  I should qualify as I have assets, home, 25yrs work experience, and still working full time. 

Can I ask your thoughts on rates a credit union just quoted me? They will do up to 25yr loan for a LLC. rate is 1% + WSJ prime so currently 4.5% + 1% = 5.5%. They do not escrow. Any way to get a fixed rate for LLC?

Hi I am new to BP. I plan to set up a series LLC for future rental income properties in TX. Any insight and connections for lending for LLC? I have read that credit unions can have more flexibility in lending to small businesses. I realize it would be cheaper to just get a traditional 30yr loan personally, but i like the idea of protection that the LLC offers. Insights?

Lending recommendations for LLC?

Real estate/business formation lawyer recommendations?

Is it easier to find a rental property in Lufkin? Im a newby, but it seems quite difficult to find the 1% property in the city of Houston without having todo major repairs (I dont have those connections yet).
