Thank you for your feedback. I will send a certified letter on Monday to the landlord.

I signed a CAR lease with a broker who represented the landlord when I moved in to a house. The RE broker is the son in law of the landlord.  After the lease period,  I moved out and cleaned the house to the same condition when I moved in. It’s been 30 days and the landlord hasn’t returned any of my $4500 security deposit and hasn’t given me any accounting even though I texted both the landlord and the broker it’s been 21 days after I moved out.  The landlord said the house was clean and it look good but there was flooding days after I moved out after the landlord turned the utilities back on. I  intend to sue the landlord in small claims court. I have no control over what happens to the house after I moved out. My question is can I make a complaint to the DRE about the broker? I informed the broker that the landlord hasn’t returned my deposit and the broker has been silent on this. Thank you.

In California, landlords are allowed to raise rent by a maximum of 10% every 12 months. That means if the CPI change is above 5%, the maximum increase caps at 10%. It's vital to understand, however, that the actual amount you can raise rent depends largely on your local city laws.

I believe its 5% plus the CPI change or 10%, whichever is lower.

Quote from @Theresa Harris:

Start by looking at the local laws.  Where I have some rentals, I have to give 90 days notice of a rent increase.

Thank you for your input. It's good advice. I've looked at the Texas laws, and it seems there is no law beyond a 30-day notice to send out a lease renewal. The property manager I have wants to give a 3-month notice each year when we send out the lease renewal. It seems too much time to me.

Quote from @Alecia Loveless:

@Jackson RodgersAgreed with the 45-60 day timeframe. At the moment I’m letting my leases go month to month unless specifically asked by the tenant to renew for another year. This does not mean that you still can’t send a notice of rent increase and say your intention is to let the lease go to month to month unless they want to sign a yearly lease.

I’ve got a closet smoker and a needy tenant that calls or texts 5-7 times a week over nothing that I’d prefer to have the option of removing. Sometimes you want those options as opposed to being locked in for another 12 months.

Very good tips Alecia. Thank you.

Hello,

How much advance notice is reasonable to send out a lease renewal contract to a tenant when the only change is a slight increase in rent? What is the typical timeframe? Thank you.

Thank you, Joe. That is what I thought but wanted to hear from others.
