5 day notice is your first step towards eviction.
Have a server serve the notice. Than after 5 days have passed, file the eviction notice at the county court house where property is located (In Illinois, if the property is NOT on your name, you will need an attorney to represent you).
I would recommend using an attorney as there are so many fine lines when it comes to evict someone.

Hello BP Members,
Pleased to announce that we bought 2 duplexes this month. It wouldn't have been possible without BiggerPockets's contribution as we have learned and networked tremendously over the last 2 years.
Special thanks to @Joshua Dorkin and @Brandon Turner for their continuous efforts to provide us a platform where we could learn and network without paying thousands of dollars to gurus.
BiggerPockets PRO membership is the best investment we have made because the returns are awesome. For example, we bought these 2 duplexes using BiggerPockets calculators and those numbers made total sense to proceed with the purchase.
So, we bought these two duplexes for $165,000, rents are $725 for each unit, $2900 total, tenants pays for all the utilities except lawn care / snow removal. And the best part is, these duplexes were built in 2011 (see pictures) and they were listed on the mls for $293,000, but we got them for $165,000.

Every State has landlord tenant laws. State of Illinois is a tenant friendly state.
In Illinois, generally speaking, tenant can get a second appearance almost every time and on the second appearance, they could demand a jury trail. So, when it goes to Jury trial, lawyers usually ask money up front.
I don't think, you will have to go to trail #2. Jury will decided in your favor (most likely), but it's a painful process. I have been twice.
Kindly stay with your attorney and follow advice or it might cost even more.

Yes, you can serve him 5 day notice in person.
Even if you mail him, he has to receive it and I bet he will ignore the mail.
Above were answers to your questions, here is my advice, use a server and have him served, you will thank me for this. Server will cost you $50, but it's worth it.

WOW! Financing is crucial. Good that you got a 4 unit though.
I did my inspections today and took a lot of pictures. I have to analyze everything now and see I want to terminate or ask for credit repair.
Do you do your own property management?

Thank you for responding.
It seems to make sense that judge will have to be convinced that landlore (It's me in this case) is not just rewording and basically it's a late fee. Having said that, wording could make a difference as to what you call it and since it's not "termed" late, it could be an additional rent if paid after due date.
And yes, the lease agreement would have to have that verbiage there.
