Quote from @Scott Matthew C.:

Hello fellow Michigander. Nice to meet you @Kinju Dudhia. Thanks for posting your awful experience.

For those who are reading this and starting out, the laws regarding a tenant's abandoned property can vary depending on the state and/or country in which the property is located. Generally, a landlord has a duty to protect the property and maintain the belongings of a tenant who has abandoned the property.

In many cases, the landlord may need to provide the tenant with a written notice of their intent to dispose of the abandoned property. The notice period can also vary depending on the state or country, but it is typically around 14 to 30 days. If the tenant fails to respond to the notice, the landlord may have the right to dispose of the property.

In addition to these laws, there may be specific provisions in the lease agreement that address the situation of an abandoned property. It's important to review the lease agreement and seek legal counsel to ensure that you are following the appropriate laws and procedures in your area.

Ultimately, the best course of action when dealing with an abandoned property is to consult with an attorney or a local housing authority to ensure that you are following the correct procedures and protecting your rights as a landlord.

Best of luck!

**I would not hesitate. Take swift action.

Thank you for your response. How do I find their new address?

How do I find their current address?

I own a property and the renters left the property with a garage full of junk, and furniture in the apartment and turned off the heat. They are behind 2 months of their rent and we do not have a forwarding address. What are my options at this point to recover the loss of rent, damages to the property, and removal of the junk?

Thank you in advance for the answers,

Kinju

Quote from @Basit Siddiqi:

One of the questions is

How did you run all the transactions from the time that property was purchased to February 2023?
You normally need an EIN to open up a bank account for an entity.

There is no such thing as 'backdating' an EIN.
Normally, you need to wait some time for the IRS to register the EIN in their date base for you to start e-filing the return.
I think you should have enough time to e-file a partnership return by the March 15th deadline.

best of luck

So just to clarify, the property was bought by n November 2021. LLC has been formed on 2/3/23. Can I fill the start date of EIN for 1/1/22?

@Kinju Dudhia I do not know why your accountant would tell  you to do that. I think you should look for another one. He needs to be able to figure it out as the current situation and not try change the past.

I agree. My old accountant retired and I had to find a new one. He had great reviews so I went to him and have submitted all my paperwork. I am thinking of a way of getting out

@Kinju Dudhia you should have the option to say when the business start date is when applying for EIN.

But can it be backdated a year before LLC is esta?
I actually read your post wrong. Sorry.

The answer is no. You can't back date EIN.
Thank you!!

Hello,

My brother and I bought a duplex in November 2021 and we are equal partners. We applied for LLC on 2/3/23. When I had an appointment with tax accountant, he wants me to apply for EIN dating 1/1/22 so we can file 1065 for tax year 2022
Can we backdate EIN prior to forming LLC?

Thank you in advance for the response.

Hello!

My brother and I have invested in a duplex. We closed on the property very recently. Mortgage is under my name and we both are on the title for the property.

Can he claim tax benefits next year?

If not what can we do so that he can as he is equally invested in the property.

Any guidance will be appreciated

Thanks in advance
