Hi Joseph,

Congratulations, this is a good situation to be in. Another option that some have done, is 1031 into a DST product that allows for a future upREIT type structure, you defer your capital gains, then you you can sell your shares of your REIT a little bit at a time based on your tax situation instead of taking it all at once. This is complicated and only available to accredited investors. But if you want to talk I can give you a few ideas on the phone that you can follow up on.

Completing a 1031 in the time frame required is a very complicated part of the process.  The DSTs also work as backups to your 'property by the lake' in the event that for some reason falls out of escrow and you can't close on that dream property.  You can complete your 1031 with the backup 2 or 3 options and continue to look at other options without losing  your 1031 tax benefit.

The important thing in these alternative real estate investments is finding someone that specializes in it.  Just like a good Realtor, you need someone who can connect you with the most options.

You in theory can sell the homes and buy an apartment complex, but getting all the transactions to line up in the 45 day identification period of a 1031 exchange might be difficult.  You should talk to a 1031 exchange QI before you list them to discuss how that process works and familiarize yourself with the time requirements of each transaction.

Have you considered looking at central oregon?  it's not too far from where you are at in WA, and it's also not a big jump from the bay area.  Lots of investors from the bay area here.  Give me a call if you want to chat about it.  The rental market is really tight here.

Does anyone know what the law is in regards to lease break/termination fees? Do they have to be reciprocal on the landlord if the landlord needs to break a lease? State is Oregon.

Hi Chris!  You will have only 45 days to identify your replacement properties so be sure to decide on a few things before you list it.  As mentioned you will need to match up the debt/equity on the new properties, but as long as you do that more than one could work.  The kicker is the 45 days to do all that.  I work with some products you may want to consider as an option.  I'm not sure if they will work for you but I'd be happy to discuss.  Send me a message and we can connect on that.

You may want to consider testing the carpet for pet urine. If there is a true smell, it will only get worse. Maybe this problematic new tenant knows more about what went on there before. If there is urine, you can charge the previous tenant to take care of that issue for good.
