I'm no expert in that field.

The broker's comment "carpet & paint" is like a used car saleman saying "Tires and oil change."

Get a list of "deferred maintenance" items in writing! Have the current owner and the broker sign it attesting to the list's completeness.

Also, do a walk through with a qualified engineer and other maintenance professionals.

Of course the broker thinks all it needs is paint and carpet but if it also needs a new A/C unit or something else major, you are out major bucks or could lose prospective tenant until the item is fixed.

How much blame can be passed on to regulators who impose and enforce new rules on banks due to past mistakes by other banks/bankers and the regulators themselves?

Which of the regulators should shoulder the most blame?

This is a terribly complicated topic. A lot may depend on the state of residence and the state in which the property is located.

I suggest, at the very least, consult an attorney who regularly practices estate planning issue. It may be wise to contact a financial planner as well especially if your estate will trigger the estate tax - Federal or state.

The Federal Estate tax was repealed during the Bush year BUT that repeal is repealed (I believe in 2011). Given that Congress has to do nothing to reenact the Estate tax, I'd bet $1 to anyone that it is reinstated.

Another issue are Medicaid rules. Hopefully, no one here is near that low level of wealth but Congress passed a law allowing for a 5 year lookback period to determine eligibility for Medicaid. If a parent goes into a Nursing Home and those expenses are paid for by Medicaid, many states can and do go after the residence after the nursing home resident and spouse have died. Again consult a professional for specifics.

Above all, these issues will change frequently over the next decade. Everyone's situation is different. Hiring a professional is a wise choce.

I would not recommend LegalZoom or any other do-it-yourself road for legal paperwork.

I has a dinner for 2 where the bill came to $190 ... and that was about 1990. It was a 5 star restaurant in San Fran. I'll never forget it. I just wish it was on an expense account.

To me a lot of the debate on health care reform can be divide by one word RESPONSIBILITY.

I feel for those that are less fortunate either through their own decisions of because they ended up in the wrong end of the gene pool. If I choose to have those feelings result in action by reaching out to those that I meet who have a need, that is my choice. My feelings and my action however in no way require a projection of responsibility (financial or otherwise) on anyone else to help that person.

Similarly, I am responsible for my own health.


Weeding through all the rhetoric and sound bites that I hear only reinforce my opinion that the current debate is not about improving Health Care or even improving access to health care and only mildly about reducing the costs of health care. The reform measures in Congress is about redividing the dollar-denominated pie.

IMHO the first step should be going after the waste in the current system that supposedly costs Billions. After that, go after tort reform.
