1 Tax ownership must stay the same from the sale of the relinquished property through the purchase of the replacement property. IF you have been reporting income and expenses under your SSN for the NC property, upon purchase of a replacement property in a 1031 exchange, you are able to purchase in an SMLLC, taking the "indivicual" tax election (not the corporate), b/c you would continue to use your SSN to report income and expenses as before. IF you choose to use this property for "short term" or "seasonal rentals" AND wish to have some personal use time, please refer to IRS Revenue Procedure 2008:16 and discuss it thoroughly with your CPA.

4. There are NO extensions to the "180-day" exchange timeline which includes the "45-day" identification period in a 1031 exchange. (The only exception would be in a federally declared disaster when the IRS issues a memo which specifically mentions extensions to the exchange timelines and issues its instructions).

we are near getting a contract, but not under contract yet:

we have a house that is so full of stuff, that an inspector will not be able to get in anywhere, and we cant confirm issues, repairs, and know what we have, before hand, with intent to wholesale, or retail it., and it will take 3 dumpsters, and maybe 3k+ of costs, labor to unload place...
what do you suggest to get under contract and inspect, for diligence, without spending $3k just to unload the house for an inspector to get in?  

2-4 dumpsters for 3 bed house W /1 garage clean out 

Dumpster- $350x 4 = $1400 

Labor $350 daily( 3 people) x 2 days= $1050 TOTAL $2450
3 days labor=$2800

We can fill 1 dumpster in one day so we might be able to cut 1 day of labor down-)

Acquired property in Raleigh NC Briercreek, 150k, few years rental, paid off cash; titled personal name, 

Selling 225k, want to buy a property elsewhere cash, look for deal, auction, and pay it in same cash, and live part time in it, and airbnb it also as rental.

will this fly as 1031 exchange, (like buy new as LLC, single member, single member live part time in property, airbnb it)

and are there legal loopholes to extend 45 day deadline for a new deal.

i have deal under contract in Va beach (a town house) with my Virginia LLC.

Matt, licensed agent, Fl, jacksonville...

contact if i may send it also..i think there is room to flip..

(BTW, ,,,,,,**  must an end buyer be a cash hard money to do assignment wholesale?

ie, if an end buyer is using a bank loan, can that be assigned to? or must you double close? or is wholesale not possible all together when bank is involved?  can you explain?)

Do you prefer end buyer to send his/her earnest money (for accepting your assignment of contract), to the title company directly, to hold escrow, as better practice of business? (as opposed to say, giving it to you or mailing it to you, your home, to cash)

i feel awkward asking it sent to me, (though i do clarify its non refundable; except for any title lien issue, etc)

my jacksonville Fl retail realtor friends say their 3 bed 2 baths, 200k and under, in select zip-codes, with slight repairs needed, get full price cash offers, all retail priced, same day, multiple offers, site unseen from internet institutional backed companies, from Miami to California..

families looking to buy at or under market get squeezed out and ignored...

these companies are like open door who are buying and then flipping with thin margin using volume, and most others others are buying to hold and lease out..

the banks, wall street asset mngrs, and govt. are flipping now too..or keeping it to rent out,,..there is alot of unseen going on.
