Tenant: On May 31st you will receive rent and late fee for March and April.

On June 12th you will receive rent and late fee for May and June.

On July 23rd you will receive rent and late fee for July and rent in advance for August.

Me: 5-day Notice to pay or quit

Tenant: Overnights a cashier's check for full overdue balance

His rent for January was late, too, and his current lease ends on June 30. What makes him think we would renew it in the midst of that kind of situation??

None for summer but we do notify tenants in winter to winterize the lawn sprinkler system (which is supplied by a dedicated well & pump) so pipes don't freeze.

Same thing happened to us - crazy electric bills on a vacant house. Once we were back in the area and got into the house ourselves we discovered on our own that the HVAC filters hadn't been changed in a year and the AC was broken, running continuously trying to heat & cool the house. Something to look into. (And yeah, all the PMs we've ever had are happy to sit back and collect their fees while making excuses and ignoring our attempts to make them actually MANAGE our properties.) Good info here about E&O insurance etc... I'm definitely taking notes!

Hi all, I have found so much useful information on BP just browsing so I decided to join. I am seeking an understanding of something in particular that I haven't been able to find in the forums.

It is likely that we will be seeking an eviction judgment against our current tenant and I am wondering how the security deposit factors into that judgment.

We will ask for rent & fees owed and court costs in the judgment. Does the security deposit only factor in after we win possession and assess the unit's condition? Then do we apply the security deposit to damages and rent owed (lease specifically states we can) and send a bill for the remainder? Do we file a partial judgment satisfaction after applying the security deposit to amounts owed?

I hope my questions are clear... I'll gladly clarify if needed. Rental property in Lexington County SC. Looking forward to your experienced insight!
