Yes I am aware of those 2 bills. I too hope the CAA has enough negotiating muscle to water down any extension.

@Bao Tran This situation as bad as it is, is actually in your favor. You just need to act really fast.

@Kyle J.  I am curious what do you think the CA government will do? Will they extend the moratorium for all types of evictions ie lease violations and holdover? Asking since my tenant is stringing me along and their lease is going to end in a couple of months.

uh..not sure how much that kind of screening helps with the incentives tenants now have to not pay. My tenant earns a high 5 figure salary and still chose to falsely claim that they were affected by covid. 

I would consider do month to month if you are really desperate for rent but if you aren't desperate it's probably better to withdraw units from the market until it becomes clear what CA decides to do.

Cozy will not give you the SSN on the report since they use a 3rd party.

If possible, try to get their SSN in some part of the application process (Eg: create another supplemental form where the tenant has to enter the SSN). You'll never know if you might need it. Of course, check if your state/city legally allows this.

I've sent comprehensive emails outlining what they need to pay (25%, 50%, etc) in accordance with the moratorium dates. I've also reminded them of the same in texts and emphasized on accountability language that CA/San Jose have provided.

The problem is CA's declaration has no other conditions. It's very easy for a tenant to send it without fear. It does not even place a notary condition on the hardship declaration.

I think tenants are hoping that that Newsom and his cronies will extend the moratorium for a long time. So they have no incentive to pay at all.

Forceful reminders isn't scaring my tenant. I've reminded them multiple times that I can go to small claims court/collections. I am going to try some of @Steve Vaughan 's pressure tactics next.

I'll admit I am very worried about what else the govmint can come up with. If I do get my SFH back, I'll be converting it to an airbnb as I am sure many other landlords here will do. Let CA deal with the mess they created.

I think you can ask for statements if they meet certain higher income requirements (CA moratorium page has more info). In your case, I can see how the tenant is impacted. Seems like a genuine case unlike mine.

When I saw the forbearance proposals come out in April 2020, it was interesting to me that none of them explicitly said in words that applying for forbearance will not be used against you in the future. A lot of the language instead was very vague. Wells Fargo in particular evolved their language several times. The way I see it is, if I were a lender why would I not use this as input into any further business I do with you?

@Kevin Connelly Do you know for sure that the tenants been having real financial trouble or are they bluffing?

If you apply for forbearance mortgage providers could use that against you when you apply for mortgages in the future.

Also I am curious, have you been seeing delinquency problems with properties you manage?
