Post: Oakland eviction - non payment technicality

A tenant paid late last month and I applied a late fee according to our lease ($75). In their Nov invoice I clearly stated that the amount paid in October went first to cover the late fee and then rent, leaving an unpaid balance due for Oct rent.

This month they paid only the usual rental amount. I would like to serve them a 3 day notice and hopefully evict. I know that Oakland's rent law says that eviction based on non-payment of rent can only be used for rent, and not late fees. However, our lease states that 'Owner may apply any payment made by Tenant to any obligation of Tenant to Owner notwithstanding any dates or other direction from Tenant that accompanies any such payment.'

Has anyone used this technicality before and/or know if this will work?

Hi Nathan,

Did you ever get an answer to your original question about limiting liability for your broker? I'm curious because I am in the same situation. My younger cousin wants to get into PM and wants to operate under my brokers license. I am concerned about the liability this will create for me. Hope to hear from you, thanks!

I purchased a building where the current owners did not have security deposits for 3 of the 7 tenants. The building had previously been in foreclosure before the current owners took it over. There was no documentation that the 3 tenants had paid deposits but they claimed they had. When I took over the building I issued change of ownership letters and stated the deposit amounts I received (or did not receive) in escrow and that if there were any discrepancies the tenant would need to contact the previous owners directly.

Hi,

Was looking for perspectives from Bay Area owners on the potential impact of seismic upgrades on soft story buildings. I have a partial soft story in Oakland and wondering what other investors are considering (do the upgrade, sell, etc)?
