Thanks @J. Martin . That's what I am confused about. So, we don't agree on what rent to charge for the new lease. How do I break the lease?

@Joey Budka - As far as I understand, Section 8 is exempt from Oakland's rent control price caps. In accordance with California and Oakland law, my increase is over 10% so I gave a 60 day notice.
My building has 7 units. For the time being I managing the property to learn the ins and outs but I may consider a triple net in the future.

I recently gave my Section 8 tenant a 60 day notice of a rental increase from $1,095 to $1,300. Section 8 reviewed my request and only approved an increase to $1,200. Any one know what my options are from here? I'm working under the assumption that I am allowed to increase the rent to what I deem as market rate (1,300). If the tenant wants to stay, they will have to cover the portion Section 8 doesn't? If they don't want to stay, then we terminate the lease?

the lease states no parking comes with the rental, but I have issued separate written 'policy' stating one vehicle, no maintenance, etc.

I have 7 units and 7 parking spaces. One tenant is using two spaces and is doing maintenance on the vehicle to top it off. It has been up on a jack for over two weeks now. I've sent two notices and a few phone calls. Tomorrow I need to move forward with my threats and tow the vehicle. Any legal repercussions I should be aware of?

No, not causing damage to the property. They let their dog do its business on the grounds and also occupy more parking spaces than allowed which causes problems for the other tenants.

Hi Phillip,
We are looking for an opportunity to evict. Oakland is rent controlled so it's not easy! They cause a host of other issues and nuisances. The most straightforward way to evict in Oakland is non-payment of rent but I'm not sure how the courts will view this technicality so I am hoping someone has been in a similar situation before or has experience with the rental board.
