A lease option is just that it is a lease with the option to purchase the property at the end of the term, it does not give them any equity in the property does not give them additional rights to the property as it is just a lease not seller financing. There are purchasing the rights to buy the property at the end of the lease for a specific purchase price, they are not buying equitable interest in the property as it is only a lease and not seller financing. However, I would recommend checking local laws, state laws and I would speak to a real estate attorney to confirm.

Ryan that is the million dollar question, here are some questions that need answered first prior to deciding which real estate investing path to travel. How much money do you have to invest, how is your credit, how much time do you have to commit to investing, and when do you want to start investing. Real estate markets run in cycles and as those cycles change many of the real estate investing techniques change. Our company LeaseOwn Homes does lease options and we try to make every deal a win-win, it makes deals easier to close and many times you can get more money as an option fee from the tenant buyer at the time of contract.

Seller financing is now regulated and there is now a lot more risk for the owner of the property, they are becoming harder to find and hard money loans on properties is extremely risky for the investor who borrows the money.

If the property has a mortgage our company LeaseOwn Homes does lease options for three years max to avoid any problems with due on sale clause or it looking like seller financing.

We set a price that will give the tenant buyers the opportunity to possibly earn equity and we give a credit back from the purchase price at the end of the term, in the contract or addendum we have the tenant buyers pay for all maintenance and repairs and a home warranty is added they pay for monthly.

The home is sold as is to avoid required inspections by the bank at the end of the term.

If your state puts the responsibility of maintenance and repairs on the owner so be it but you can still put it in the terms and hopefully the tenant buyers will take care of it.

you need to have a assignment contract with the owner of the property, the contract needs to state you are assigning your rights to the contract to a third party for a fee.

Also you will need written permission if you are going to market the property to find an end buyer or also known as tenant buyer.

You will also need to know need to have the purchase price, monthly rent and term on the contract you will be assigning.

I would not recommend going it alone, make sure you have someone experienced in lease options to help you avoid costly mistakes.

If you want to be a successful real estate investor you need to find a good real estate investment coach, it is vital to set your goals first. Not your financial goals but if money was no longer an object what would you do different in your life? what do you have passion for? whatever that is you need to create a business plan, an action plan, take action and let NOTHING come between you and your goals.

Those who say they can and those who say they can't are both right, which one are you? What does this have to do with real estate? Everything. The property you buy, the profit you make and the exit strategy you have are very important, most real estate agents will just show you homes till you buy one. Most real estate agents are not investors, they know nothing about loans and care nothing about your goals.

Make sure you have a good plan, a good coach and a good reason before you get started, follow your dreams NOW...

What type of investing are your doing? I am a business coach as well as an investor and I always create a business model and a list of goals with a realistic plan of action to reach those goals.
