@Disi Zhao the question I would ask, why did you buy that property in the first place? Did you want cash flow or appreciation? Your cash flow does not look too good. Your equity seems minimal. 

Do you think your market will appreciate fast enough? then,  hold it another few years (assuming you can sustain the maintenance and any negative cash flow) ...

If you are struggle with the maintenance and suddenly got nervous about negative cash flow, then sell it. 

You might need to think about an exit strategy before the acquisition in the future ??

@Jake Walroth if it is a TAW, I would recommend a new documentation. If it is a 12-months lease, you might have to wait until the existing lease is expired.

Well this is my all out eviction, my first

My constable did the 14 days notice, as well as the Summary Process

I went to court, and the tenant never showed up. I got a Default Judgement on them. I have to wait for another 10 days before I can submit "Request for Execution". With this letter, I can hire a constable, moving company, and storage to physically remove them... It is a good experience after all.. I know a lady that attends my local RE meeting who can help post a bad credit on the tenant credit report. I want to know about the collection for all the accumulative cost, small claim?? (can I even submit this with active summary process on this tenant. I know summary process sticks for 20 years, and I can keep collecting from them. Take them to court. Not sure if I can jail them if I granted the right to pay back after the small claim ... These are steps that I have gone through in the past. So, I am exploring my options..

I know you can post on their credit report, and it will stay on it for 7 years. The agency lady that attends my local real estate meeting can help post this. 

I was hoping I can put them in jail or notify their employer somehow with the legal meant....

14 day - free if you do

21 days - roughly 210 between court and constable

7-10 - free but the wait

3 day - sheriff with moving company upwards of 2500

total with loss rent over 5K, so hope they leave on their own and you lose 1-2 month rent.

 Hi Rich, do you know what is the next process? What paperwork can I file to recover the cost and/or take the tenant to jail?

Hi BP, 

I am going through an eviction process right now. I would like to find out what else I can proceed with to recover the expenses / damage after the execution. The following is my eviction timeline

1) Tenant stopped paying rent

2) After about one and half week, I sent in 14 days notice to quit (through a constable). 

3) The 14 days notice was expired, I sent in the Summary Process (through a constable) [too about 14 days]

4) I was called to court. I went to court, and the tenant never showed up [took 14 days]

5) I received a default judgement [took about 8 days]

6) On the letter, I need to wait 10 days before I can request for execution (a letter that I can give to constable to physically remove tenants and their belonging to a storage [took 10 days]

7) ???? what paperwork should or can I file next to recover the cost and/or send the tenant to jail??

Any idea or input, thank you ahead.

@Karen Bickford Yes, this was inherited. Unfortunately, it is not much I could do. Landlording is still a cool gig though due to the financial security and independent. 

@Karen Bickford I am still learning about the regulation. I know the court is pretty tenant friendly, but the town policy in general is ridiculously friendly toward tenant. I meant a stain on the wall that caused by the tenant. I meant eventually I will go that way to become a slum lord. If you try your hardest to keep up with the pretty, then tenant came along and use the system against you. Really ... You sent them a notice to vacant, then they quickly call the board of health on you just to retaliate .... unbelievable.  The board of health strictly came up with like 20 items for you to address like stain wall, old toilet seat, .... etc.

What can landlord do to prevent or compensate for the Board of health visit?

Typically, when landlord sends a notice to quit/vacant the property, the first thing tenant does is calling the board of health. The board of health will show up without announcing, and they would pick on every little thing to make the building fail. With this finding, landlord can't raise rent or evict the tenant??? Doing so will consider retaliation. This is crazy ...

Does any landlord have a clause in their rental agreement stating that "tenant must upkeep the property to a condition and standard satisfy by the board of health State Sanity Code"?

@Gail K. Thanks for the feedback. The tenant is TAW, so the Constable had already delivered the 30 days notice. I think this is a tough fight, and we might have to go to court to remove them.
