MTM?  If they are rolling over from a prior lease then it should prevail and go MTM automatically, what am I missing?

I personally do not know.  But I believe it is only a couple hundred dollars since it isn’t covering the structure and is only liability.  I require it for all my rentals and I am listed on the additionally insured.  I know that it is not cost prohibitive.

To add to this. To find an eviction attorney, I recommend that you reach out to your local REIA. They will have an attorney that specializes in evictions and would be less costly than an attorney that doesn't do evictions regularly.

Did you require your tenants to have renters insurance?  This isn't a unique situation.  People get bounce houses all the time.  If it is on a grassy area, they should be fine.  You can ask that the tenants sign something indemnifying you of any damage.

The same landlord that gave you a good review called later and gave you info on how bad of people they are.  First let’s point out the obvious, which is the integrity of the landlord.   They lied to you.  Can you really trust them now?   Know that there are 3 sides to every story.  

It may be some unsettling things to hear but you can’t act on it.  Does it make sense to you that an HVAC tech wouldn’t service without explanation?  I would imagine they would want to get paid at the very least for their service call.  The landlord that called you didn’t go themselves.  There are lots of flags in what you were told.  Maybe the landlord wronged your current tenants and now he is dirting them after he lied to you.


The reality is you are in contract with them.  Just keep an eye on the situation, but don’t be hypersensitive.  You don’t want to force the situation to go south.  You accepted them.  Stop doubting yourself and just roll with what you are dealt with.

The question I have is if they paid rent for June or when was rent paid until?

if they paid for the month of June then there is nothing you can do.  What do your state laws say about belongs that are abandoned?   What does the daughter say?  You could move all their belongings into a self storage and hold them there for a month or 2 before disposing or they can take over the cost of the storage.  That will allow you to get access to the apartment.

This is what kills me.  When someone comes across issues they blame it on improving their "team."  Whether you have a team or  not, you need to manage the team, give them direction and guidance.  You need to take the lead.  At the end of the day it is your money at risk.  

Part of managing a good team is taking ownership.

I wouldn’t hold any security deposit unless there is damage that needs repairs.  What difference does it make if they gave you 14 days additional?  You know there is a domestic violence issue.  You can make the decision.

I think you got a professional tenant.  What did their credit and income look like?  

I would start the eviction process. Check with your local REIA for an attorney
