Took everyone's advice after getting another story last night and today and gave them until Sunday to be out.  Just told them there would be no court if they left peacefully and if they didn't leave I would take them to court for all damages and past due rents so they said they will be out. Now I just hope they will be.

thank you both for the advise.  I really do appreciate it.  It is a serious business I guess I am just too soft to the stories.  It is a very complicated situation that I wasn't 100% sure how to handle while not losing a lot of money.  The tennant on the lease moved to a different city almost 3 hours away, and left the apartment for her son and girlfriend without saying a word to me.  She paid part of the rent and split.  I have given several 3 day notice of intent to evict and usually that is when I get paid is within the 3 days.  I was just wondering if it is better to eventually get the money or lose a month or 2 rent and hopefully get a better tennant.

Yes they pay the late fee along with the rent.  The previous owner of the property worked out an agreement with these people to have lower rent because the apartment they are in needs some extensive remodeling.  Everything is up to code but could use new flooring a remodeled kitchen and new Windows.  I haven't had time to do the upgrades yet but they seem to keep getting later and later but I do eventually get it because they know I mean business and if they don't get it paid they are out.  Just wondering how long should I let this go on or if I should bite the bullet get them out and do my remodeling and increase the rent.

I have a tennant who is always late paying their rent.  Every month I add a $50 late fee that was stated in the lease and I eventually get paid but us usually the last week of the month.  Is it worth working with them or do you take the risk of eviction and having lose a months rent to get a new tennant.  The marking is great and it wouldn't be open long but I would have a little remodeling to do in return I could also raise the rent from what it is now.

thanks for the replies. Yes I will use this to educate myself a lot.  I do usually screen the people very well, this tennant was living there when I took ownership. They are usually quiet from what I have seen but here in ND the police don't contact the owner when they enter the property and if you find out they did and try to find out why they won't tell you.

hi there I have been in real estate for a few years now but have never had this problem come up and kinda wondering how to handle the situation.  Last month I had to fight to get rent from one of my apartments and when I finally did I found out one of the people on the lease moved to a different town. The lady's son who is also on the lease would like to stay in the apartment but add his girlfriend to the lease because she is on probation and needs to be on it to live there.  Now I hear from neighbors that her Probation Officer was doing a check to approve her to live there and found drugs and caked in the drug task force to search the apartment.  Now the one who had the drugs wasn't either of them but a friend who was staying there so I have heard.  Well the Lease just came up as of today.  Do I have to renew the lease and if not do I still have to file eviction to get them out since it is up? Any insite would be great. Thank you

I did not actually step into the apartment because they turned on a light as I opened the door and couldn't believe I was actually there.  Thank you for the help.  I will get the paper work filed so that way they can't get another month squeezed out of me.

Hi I am looking for some insite on how to get bad Tennants out.  I have a set of Tennants that have been living in my 3 plex for 2 years, I have owned it a year and they have played many games but usually work things out.  Recently they only paid half of their rent in December and have paid nothing in January and now it is February.  I delivered them a 3 day notice of intent to evict on January 10th told them I would no longer work with them and I would give them a week to get out.  Well after the week they asked for 2 more days to finish everything up I said ok.  Well I went over to the residence 3 days later doors were locked and I knocked and no one answered the door so I assumed they were gone so I went in and the Tennants were sitting on the couch in the dark and no packing had even began.  Well this caused an argument and well they are packing now but keep telling me they will be out and will be out and nothing is moved yet.  How can I get them out without having to spend the money for court. They are packing so do I really just wait it out? Any help would be great. Thank you

I am wondering if there are any benefits of setting up realestate as a LLP or a corporation over not. I have talked with my banker and they told me that no matter how it is set up they would look at personal and business records for funding, and I have talked with my tax person and they said as long as I keep receipts they can keep it under personal, and my insurance provider said that I am covered on that end with lots of insurance just wondering if there are any other benefits. Thanks

It is the reason my Mom and Dad got divorced when I was 3 yrs old was because of his drug and alcohol issues. He has been to treatment he says he did more drugs in treatment than on the outside. His common phrase is you can't teach an old dog new tricks. I am not trying to place blame on anything I was just looking for some feedback on what I can do to calm him down? Has anyone ever had an investor that helped with a deal and shortly after want to recind on the deal and freaks out? Ohh by the way my age is 32.
