@John McGrath I'd prefer Boone over Gatlinburg. Totally different atmospheres. I don't know the local regulations there however. I haven't heard about restrictions against STR.

A critical thing many people neglect is planning. We do so much of it for our business, generating deals, and future goals- then fail to plan how to keep as much as we're allowed per tax code.

Hiring someone to do your taxes is one thing. How about hiring someone to help with your Tax Planning and Strategy?

I live in and do invest in this market. I disagree that the city being most up to date. I would bet they don't have an answer to questions regarding new Senate Bill 483. Raleigh's STR restrictions were based off Asheville's and they are being scrutinized that their restrictions violate S.B. 483.

The city is doing what they want to do. They aren't particularly on landowners sides nor care about landowners rights. Of course it's important to get their interpretation, though I don't necessarily believe it's in my best interest to rely on their answers alone. Asking city staff questions doesn't protect a landowner. We need these things in print. Thats the point of this thread- seeing what is in print and distributed by the city. There's not much on the topic- which is likely intentional.

Here's more reading material on things going on in the state. These "random blogs" and websites are absolutely sources to keep tabs on. If something is occuring in another area it may be setting a precedent for ours. Asheville staff aren't going to announce it.

Doing more research- I find that the kitchen discussion is over a year old and just being revisit.

@Derek Robinson I've found several articles/documents discussing ADUs. I am unsure if the information I've found is outdated. From what I gather, ADUs can have full kitchens. Though, Homestay areas can not have a full kitchen.

I thought I had read something stating ADUs could not be used as a homestay- though I can no longer find that.

Ultimately, the question is can an ADU be used as a STR. If it can, I assume it must be part of the homestay. Are you suggesting otherwise?

Just read this article and thought I'd share.

Help me understand this:

"An accessory unit, not part of someone’s home, can be rented as a short-term rental as long as the owner follows restrictions around the kitchen definition."

My understanding was ADUs were not allowed.
