Greetings,

I am in the process of acquiring a family home.  I am looking for recommendations for a local attorney to help with the documents.  The home is in the Landis/Salisbury area.  If anyone has any recommendations for local attorney's I would appreciate it.

Thanks @Yvette M..  I didn't think about potential problems in the eviction process.  I thought it would be more straight forward having less tenants to serve. 

@Jonathan Smith- Thanks Jonathan.  That was my thought as well.  I have done this in the past and the tenant seemed to be more responsive to all  my emails when I included the co-signer as well.  The husband is a truck driver and the wife is a CPA.  When we talked about the transition and employment, they have both said that they have had interviews, but the companies wanted to wait until they were here to hire them.  They do have savings built up, but I am sure even with the military PCS'ing them they will still have some expenses getting settled.  I appreciate your insight.

@Yvette M.- The cosigner would be one of their parents.  Both of their families live in town, so I think that would help.

@Angela Hollis- The tenant is getting out of the military not retiring.  I didn't think about asking for proof of funds, but that's a great idea.  They have said they have a savings built up that would cover the first 4 months rent.  I use the SmartMove application through Transunion and they both have good credit, no criminal, or eviction history.  I appreciate your insight.

@Account Closed- Hey Greg, I empathize with the guy as I had to transition out of the military and know how difficult that can be.  The market is not bad at all.  I have had a quite a few people interested in the house.  I ran both the tenants credit and they have good credit in the low 700's.  I appreciate your input.

Good afternoon,

I have a question about screening potential tenants who are transitioning from the Military and moving from Alaska.  The husband will be receiving his military paycheck until February, but they do not have jobs lined up in North Carolina yet.  I have asked for a cosigner who currently has the adequate income to make the rental payment and a good credit score.  Do you think adding the  cosigner will cover my basis on renting to the couple?  I empathize with them being that far away and transitioning out of the military, but I also want to cover my basis making the house payment.  I appreciate everyones input.

Quick Update: The tenant paid the August rent on Wednesday and said it wont be a problem paying Septembers on time.  I spoke with an  NC lawyer who reviewed my lease and gave me a few things of note.  She said the lease was pretty comprehensive, but recommended next time I use the NC standard lease.  I will definitely be prepared for September if she doesn't pay.  I'm still looking for a management company that covers Creedmoor, NC.  I appreciate everyone's feedback and suggestions.  This was a learning experience that could have cost me an extra months rent.  Never again!!!

Alright guys, it looks like she didn't pay today.  I spoke with a lawyer today and she said I should send the 10 day letter and if she doesn't pay to wait until September 6th to file for Summary Ejectment that way it covers both months of missed rent.  Does anyone have a templated l0 day letter they wouldn't mind sharing?  I greatly appreciate everyone's help.

Hey guys, I finally got an email from the tenant on Saturday morning.  Of course she has another excuse, but says the rent will be in the account Monday.  She has even scheduled a conference call between both of us and the bank to verify her story.  I still have an appointment with the lawyer at 4 so if the rent isn't in the account by then I am moving forward with the eviction.  I am a bit concerned that if she does pay the rent tomorrow I will be going through this again in 8 days when the September rent is due.  I will post again to do an update.  I appreciate everyone's feedback.

Thanks @Chris Martin.  I didn't think that would make that much of a difference between cities since they are relatively close, but it makes sense.  I did my lease through Rocket Lawyer which seemed pretty comprehensive, but I will have to go back and review the eviction section of the lease just in case.  I spoke with an attorney from Raleigh that wants $600 to file and go to court if necessary.  I am considering just typing up a 10 Day Notice to Quit or Pay and having someone tape it to the door.  A frustrating process being out of state, but I guess everyone has to go through it.  Thanks for sending the DIY documents. 

Thanks @Justin Fraser, I have left a few messages to attorneys I have found online.  Hopefully its not too late to get it started before the weekend.

Thanks everyone for the great advise.  I'm sure I will have to find an attorney for this one in the Raleigh Durham area.  Does anyone have any suggestions?  This is definitely a learning experience for me.  Hopefully not too costly.

@Louis Bratton- I would definitely be interested in getting the packet from you.  Let me know what you need to send it and I will make sure you have it.  I think for this one since I have waited a while I am going to go with an attorney to expedite it.

@Kyle R. any suggestions for attorneys in the RDU area?  I will PM you for the clause waiving the 10 days.

@Curtis Waters this definitely makes a strong case for a property manager.  We just moved out of the house less than a year ago and the margins aren't great, but I'm sure it would be worth it not to have to do this from Hawaii.  Also good point about having at least one party in court.  I think I could have someone represent me that is still local, but definitely a good thing to keep in mind.
