I need a recommendation for an attorney to start summary ejectment on my behalf in NC (I recently moved 2 states away).
I would drive back and file myself (drive is only 6.5 hrs) but I don't know how soon I would need to return to take the next step in proceedings (I've never evicted a tenant before).
I think it might be best if I get an attorney to work this out for me since I'm out of state... Please let me know your recommendations or if you think I should drive back and file the paperwork myself (how soon would I need to return?)/
Lastly, in the state of NC, do I need to notify tenant about eviction before I begin?

@Simcha Davidman I didn't find out much information about utility allowances... But I have enough of an understanding to give me the confidence to go for another LIHTC property if I wanted to. And I did purchase the property.

@Thomas S. Thanks for the explanation. That was conclusion I’d come to before making this thread but wasn’t totally sure...
I learned that NC landlords are simply not legally allowed to charge a late fee until after five days past due... So a pay/quit notice can be issued on the 2nd day rent is past due...
Anyhow, this all helps. Thanks again everyone.

- By law (in NC), you are not allowed to collect a late fee for rent until 5 days after rent is due.... is that correct?
- On which day would I be allowed to actually mail/post/serve a 10-day notice to quit? The 2nd? (since rent is technically late on the 2nd?)
The day after rent is late, I plan to mail and email a 10-day notice to the tenant (or is email a bad idea? Do any of you email as well as mail? Or do you just post the 10-day notice on the tenant's door?)

Signed lease gets the tenant the unit, no hold policuy: makes sense.
I actually have another applicant (non-Section 8) whose current lease ends March 31st.
If she agrees to sign the lease for my unit, say, next week (March 11th), would I just pro-rate the rent for her for the remainder of March and collect 1-mth's security deposit? ... And have her move in on April 1st... Is that done?
Does that make sense?
(and by the way, this would be my first lease-signing on a property ever, hence all the questions).

@Amy Beth Yes - after reviewing everyone's feedback, 2 mths is definitely too long.
@Wesley W. You're right - HA approval would have made the whole transition even longer. Good points!
@Rick Beno I'd actually made the 'move-in' question apart of my list of pre-screening questions but I just stopped asking after a while it b/c I didn't understand just HOW significant that information was... Now, I'm going to move it BACK to and on TOP of my pre-screening list.
