Agree that one bad check case doesn't sound like deadbeat behavior. However, my issue with a bad check court case is it took time, effort, and money on the part of the plaintiff to get it to court. Now, if you want to potentially have to make that effort, then disregard recent court cases such as this. Once a person has gone 24-30 months past such a court case, thus showing that this isn't a pattern of behavior, then I can see allowing the issue to pass.

In a word, no. No recent bad check payments, especially within the last 12 months (any bad credit or negative financial issues need to be 24-30 months in the past), no evictions...ever, no domestic violence in the last 10 years, no violent crime cases in the last 20 years and the list goes on. Especially in your own house.

Yes, Kevin, we too have that here in Central Florida. I believe it is done to keep houses from being used as rooming houses. With the way that families are fractured these days, with grand parents, parents, children and grand children all living under the same roof sometimes, I will say that it is largely ignored unless there are neighbor complaints.

Looking at it from another point, I simply won't rent to more than two unrelated people because I don't want to get into a "roommate" situation where one tenant is paying rent and the others aren't. I try to keep my single family residences single family if at all possible.

Unfortunately, if the tenant wants to be a pain in the butt at this point, you're best bet is to hope that she moves when she agreed to move. Worst case scenario is she may push you into an eviction proceeding. As for the damage deposit, sorry to say but I'm willing to bet you'll find enough damage to eat up the full amount.

As an aside, have you tried just talking to her? Try to appeal to her sense of fairness. Tell her that her refusal to allow showings is making you think that she has something to hide and that you want to come in now and do a mechanical inspection just to make sure that everything is operating properly.

My leases say that I can enter, upon 24 hour notice, to inspect the property. In a situation like this, I let the tenant know that I'm not asking but informing them that I WILL enter whether they are home or not. If they still push back I wait until they are at work and then enter, leaving a note on the counter that I've been there and the issues that I observed.

Clear their stuff out, video the unit, change the locks and start the recycle for a new tenant.

Aaron, are you allowed to contact the HOA directly? If so, I would imagine that they are just as eager to start having the house maintained again which, logic would dictate, that they should work with you as far as the fees are concerned. I can see paying the back fees but $10k in interest? That should go away.

I've used Chase Quickpay, which is free for all parties. You can automate the monthly request for money, which is an easy way to get that reminder out on the 31st.

No partial payments are allowed, which is another plus.

So the tenant saves gas and time or the cost of a stamp, and the landlord doesn't have to take the check to the bank. That's a win-win.

Yeah, Paypal fees are prohibitive but, eRentpayment only charges three dollars, which is a much more tolerable fee.

Reject her for two reasons, 1) the jump in rent as opposed to her income and 2) the uncertainty of her husband coming in during the lease term. If he comes in and hates the apartment, she will move regardless of your agreement with her. Take one of your other overly qualified applicants. ;)
