Hi Ron, I've only had ONE file ever OFAC audited, which was last year. This isn't being done. You know when it's being audited because the lender will ask for a social security of the buyer or even passport or drivers license, which typically NEVER gets asked for. I would say maybe 1 in 30 files get flagged for this, so IMO, you still will be able to assign the unicorn if it comes your way, which will be rare, but as I said most short sale approvals have the buyer listed right in the approval which would prohibit an assignment. Same with back to back closings. RARE, but can be done still.

If you are looking to charge a flat fee to negotiate, you will likely make more LISTING it. Usually commission is higher than a negotiation fee, although I've seen some fees up to 20K but I know a BK trustee was involved and wanted $$ out of the deal too. Also you CAN assign a short sale, on certain sales, but they are the unicorns. They don't happen often. We've done them. You have to have an approval letter that doesn't list the buyer's name, which is rare, but again does happen. You may also want to run it by the bank, but yes on a rare rare rare rare occasion you can assign a short sale.
