Hey this seems like a long shot now with how many posts there are with people looking for tickets. I’m looking for 30 tickets!!! One for every person in this thread hahahaha!!! But seriously, I just need a ticket for myself… and everyone else here! Can the admins just expand the event for us?! Pleaaaasse :))

So how do distinguish a "referral" fee from a fee based upon the sale of real estate?  That's usually why you need a RE license.

Just to clarify, I have a license and it is active, just not hung with a broker. 

 A fee based on the sale, a commission, is if you're performing licensed activities like writing offers, RPA's, doing showing, etc.

OOC - This wholesaling company have a RE license like with a principal (or whatever Cali calls it) broker?

So after much research.

On regular open market deals: It’s 100% legal in CA to receive a referral fee if you’re licensed and not with a broker.

If you’re not licensed, it’s 100% legal to receive referral fees if the deal is all cash, or investor buyer, or seller financed.


So now I’m trying to educate this huge nationwide wholesale broker on CA law :/

I haven’t hung my license with a broker for a number of years, and I’m getting back into some wholesaling and referral type deals. I have one wholesaling company that won’t pay a referral fee to an unbrokered licensee, even though the California DRE says it’s OK to receive referral fees as long as you don’t do any licensed activities.

So I need to hang my license with a broker in order to receive my referral fee on this deal that’s in escrow.

I basically just need a broker of record to receive the referral fee and then pay me out, and occasionally take a listing here or there if I get one.


or are they way off base on this one?
