So, what are you telling the seller? Do you tell the seller that you will buy it cash? Or do you inform them of your plan to assign the contract?

I've never heard of the association being liable, but that doesn't mean it's not possible. Usually if there is a leak from an above unit, then that owner would be liable, but If the top unit is vacant or unowned then you would be liable. If it's as bad as you say, you may have to replace the a/c unit and possibly the air ducts, just something to think about. If you completely remove the mold and all is good then it shouldn't scare away buyers or hurt your resale. Just my .02 cents.

Usually in court the person with the most money wins. I don't think the squatter has enough money to fight her in court and win. She could legally draw it out as long as necessary and it is doubtful that the squatter would be able to continually pay his/her lawyer to keep fighting. I may be off entirely on this, but seems like it would be the case.

Rough situation. I would throw a termite tent over the house, I don't think he would stay if he knows that chemicals are coming. Hope all works out for you.

I do not leave EMD with my sellers. I leave $100 at my title company in escrow for the house I am wholesaling.
That's what I'm trying to do. How is this accomplished?

Hey Everyone,
I am interested in starting in wholesaling, I'm kind of stuck on the Ernest money part and was hoping you could better inform me. When I get a property under contract is it always necessary to put down an Ernest money deposit? If I do put down an EM and don't have a buyer within time, is it possible to retrieve it or is it lost?
