Currently, I believe we do a better job in screening than the FBI. 2nd Amendment, U.S. Constitution is not up for grabs. 

 So we pretty much confirmed that erentpayment has cheated, weather by neglect or intent is yet to be determined. 

 But just who did they cheat?

Who should be the victim here? The tenant who made the payment faithfully or the landlord who's  simply made the convenience of online pay available. 

 Both cannot be the victim.  As landlords do we let the tenant know that we still expect payment? Or do we acknowledge their good faith attempt and absorb the loss ourselves? Looking forward to hear  the PB business community response. 

I too have now experienced what is looking like a loss using eRentPayment. I have contacted erentpayment about a transfer that shows (processed) but I did not receive the funds. Another transaction still shows "pending" after 8 days. They did not return my emails, and when I called I got a message stating they do not accept phone call, but suggested I email them.

 To make long story shorter, I contacted the BBB, the could only say they were updating their info on this company. I contact my state atty gen. office, who told me they had not received any info from other states about an investigation into eRentPayment.com. They did give me the state or origin for eRentPayment, Colorado.

I contacted the atty. gen. office in Colorado and explained my situation and suspicion. They promptly returned my call and requested I file a report with the FBI IC3 (internet crime complaint center) https://complaint.ic3.gov/default.aspx?#. They also requested I file a report with their office, https://www.stopfraudcolorado.gov/. I have since done this and advised my tenants not to use erentpayment any longer.

Welcome aboard, there's a lot of good information, discussions, and knowledge here at BP.

... And it seemed so clear in my mind when I wrote it. But now as I read it, is it too late to blame the dog? Ok, we have property in an LLC and I want to use some of the equity to assist my son purchase a duplex as an investment. He is a member of the LLC. He will eventually pay back the loan. Using the gift tax exclusion will not be helpful because he will be reimbursing the LLC over a short time. So what's the best way to do this? Does an LLC require that the loan be secured with a 2nd on the new property or can an LLC make a unsecured loan to a member? Or are there other options? I'm looking through the operating agreement but nothing is jumping out at me.
Our LLC is about 12 years old. My son, who is a member of the LLC is looking at buying a duplex. I want to help him with the down with an established no interest (except for the cost of extracting equity from a property) repayment schedule. Just looking into this, haven't spoke to an attorney or accountant yet. We were thinking using the gifting tool but I don't know if I need to or how to cover the LLC's expenditure. Any suggestions of how to go about this.

Hi Jim, heres my two cents. 1. I have a form that spells out just what will happen with the unit hold money if they failed to follow through by a given time.  It's not one-sided, it also holds us accountable to make sure  the unit is available and ready the day we agreed upon. 

Not having that, 

2. If you have an attorney that you work with on occasion I would contact him or her and just run it by them. I've often found they will just give me a quick suggestion of how to proceed. It may or may not be worth the hassle it could  generate.
