Just to clarify.  A Foreclosure is not always 'yet' free and clear, but it should be. 

There are many (MANY) cased were liens were missed in the foreclosure process and have to go back through foreclosure.

As long as you do a title search, you shouldn't close until the seller provides clear title.

You can look into buying bulk mortgage notes in default.  

If you go the 'bulk reo' route, you can count on a bundle of nationwide houses with major problems or little-to-no value, packaged around $1M+.  These are typically set-up for hedge funds who only need a 10% overall return.

Do you mean National Field Services or the complete Agent/Title/Field Services/Seller management?

-- If it's just field services, you need a nationwide network of contractors that will work at extremely competitive rates.

-- You also need to be very systematized and staffed to handle hundreds/thousands of work orders.

-- Once the company is 'scale-able' then you need to secure BIG accounts.

You are always rolling the dice when you sell real estate, so the bank had a list price, and decided to save 5% by not putting it on MLS and selling now privately vs what, paying commission, listing on MLS and potentially having to wait another few months to get the cash, hoping to get an bid 6% over listing price?  

 In this economy banks are taking HUGE losses.   They are not making money, they are limiting losses.

It's rare that an REO skips the MLS but it does happen. Possibilities are Auctions and HUD homes that did not get tasked for MLS (use to access issues or Lottory Periods)

It's going to need to go on the market. They have to show investors i had market exposure. Set-up an MLS auto-update and be the first offer in. Depending on the bank it might also have a first look period where your chances get reduced further as an investor.

   If you want to be a little saavy, you and try to find out who sells for the particular lender and get a foot in the door prior to list.

- You can take classes at most local Board of Realtors.

- I've never heard of any legal issues with assigning a contract.

- There are a number possible tax waivers when your in a short sale situation (i.e. insolvency, Mortgage Debt Relief Act).   They need to talk to a Tax Advisor.

- 'Free and Clear' after Foreclosure + Bankruptcy?  ..  if you don't mind having toxic credit for a long time.

- Deficiency judgements are NOT rare.
