Post: Title insurance for Alabama tax deed. Already have quiet title.

I acquired the tax certificate in 2017, and acquired the tax deed in 2020. The quiet title was completed January 2021 but Fidelity National Title will not provide insurance until I've have the tax deed for 3 years.
Any suggestions for another title insurance company that will provide coverage for a tax deed that has a quiet title?

I understand that it is difficult to prove that a vacant house or lot is "abandoned". In theory, an ejectment would prove that the property was abandoned. However, my attorney doesn't see how to file an ejectment on a vacant house or lot because we can't find the correct person to serve. Has anyone filed an ejectment on a vacant house or lot in Alabama?

Hi Denise, you and I discussed that, while you didn't know of any title companies who would provide insurance without a quiet title, that didn't necessarily mean that none of them would do it. I posted here as a last resort to see if anyone else knew of a title insurance company that would help in this situation.

In personam is cheaper, but I haven’t encountered a tax deed situation of a vacant house/lot where in personam is an option. What information would I need to pursue an in personam quiet title?

I understand the circumstances and why title insurance companies are hesitant to provide insurance, but was hoping for a few examples of title insurance companies that would work with you despite the lack of a quiet title.
A quitclaim deed isn’t really an option for a buyer that demands title insurance. How does owner financing help the situation?

I’ve had the deed (eg not just the tax lien) and possession for over 3 years and was denied title insurance when trying to sell it because I haven’t filed a quiet title yet. I don’t want to spend $3k on an in rem quiet title for a property only worth $11k. Any suggestions for title insurance companies who can help?
