I think the argument  they made was from a legal point of view, but if you close on it first you do own it temporarily, they overlooked the fact that I basically double close all the time.

I think demand has temporarily increased due to Prop 15 in CA, which is going to increase the assessed value of non-residential commercial properties to FMV instead of last purchase price (if it passes, polling suggests it will).

New construction is likely the biggest risk factor in multifamily where a softening of the economy mixed with new units hitting the market can temporarily create a race to the bottom on pricing.
