But if a tenant defaults they have a right for due process to contest the eviction.We see people try and do this with having a borrower on seller finance sign the deed back over to the lender and if they miss a payment the lender can record the deed back into their name.

(I can say that as someone from massachusetts)But people need to be careful as a CFD is consumer debt and if the borrower contests - all that interest they owe you could be wiped out as if you are not sending statements, I believe the law is then interest could be wiped out and considered invalid.

I also have witnessed very serious investors do an appraisal on the property before a refinance or sale to have something in their back pocket in case they need to contest the banks appraisal.
