Not adequate fencing for emotional support dog in New York State

I've got a tenant who has an emotional support dog but my property doesn't have the fencing or a gate to keep the dog contained. If I'm liable for a dog that edgily runs down the street and bites someone, is The tenant responsible to install fencing and gate?
