We have a neighbor of a tenant that has called the hoa regarding the tenant smoking in the back yard.

And? Is there an HOA rule against smoking in the back yard? If not, don't worry about it. Ask the tenant to smoke at least 10-15 feet away from any windows or doors so the smoke doesn't waft into the neighbor's home. Other than that, this is a non-issue.
