I have a tenant (prospective) lease already signed for $3400.00 section 8 is saying they are only obligated to pay based on their comps $3067.00. Can I break the lease as a landlord with no penalty for tenant not being able to meet the rent amount?

If you and the tenant both mutually agree to cancel the lease, there should be no problem. I'd just inform the Section 8 authority quickly. If you have unilaterally decided that they cannot make the $3,400 payment, you would be in breach of your lease contract by cancelling it. It is very common for Section 8 residents to cover the portion of their lease not covered by the voucher payments. In your case it is only $333 per month the resident would need to cover.

It's common for tenants to pay the remainder of the rent after the voucher. I would definitely get in touch with Section 8 if you have any concerns.

@Greg Scott wouldn’t accepting monies over the alloyed voucher be illegal? That was my thought but I don’t want to get into legal trouble over 300 dollars!

Well, I learned something new then. I swear I’ve seen posters here say that their section 8 pays a percentage of the scheduled rent for a property based on its beds/baths. And that the tenant isn’t allowed to pay extra as it proves they don’t need as much assistance as they claim to. Maybe someone will see section 8 pop up in their keyword search and chime in. Or maybe it was years ago and things change. Glad it worked out for you.
