I was hoping for an answer to my original question.  Can a tenant refuse a scheduled entry?  If he does not allow the entry, what are my options?

Like I said before, they wont do ANYTHING without a court order.  I asked the city cops AND the constable for a civil standby while I gave him the non renewal notice.  and was told the same thing by both of them.  Without a court order, they do not get involved.

They can only serve after a court order has been issued.   I just want to check on my property.

This is in Texas.

I have a situation where some domestic violence has occurred and the wife has told me he trashed the house.    I contacted him today and told him I was coming by for an inspection tomorrow.   He has not responded and I don't believe he will.  I went by today and tried to serve a lease termination for end of next month, since he is on month to month.  He refused to come to the door, I know he was there, because 10 minutes earlier his car had not been in the driveway.

The back door has been kicked in, and I do have a set of keys.   If he does not come to the door, I am going to gain entry one way or the other.  

What can he refuse?

I didn't forget, I just can't imagine any state law that would not allow late fees to be deducted from a deposit.    I guess it's conceivable if you live a in a jurisdiction ran by nutballs, like Seattle, but I'd say it's rare

How much longer do they have on their lease?   Might be easier and less costly just to not renew, and then deduct it from the deposit.

I tell my tenants that these things are their responsibility, but twice a year, I take a day to visit each house and change them myself.  Gives me a chance to look the place over, and to remind them again to change them.  I have a 20% compliance with them changing them.  LOL

I filed the eviction today, the clerk at JP court was very helpful.  She told me to go to a website and verify that the tenant is not active duty military and to bring that form to court.   She scheduled the court date to be convenient for me.

I doubt the tenant will even show, she should be moved out by then, but once I get the eviction, I will go back to court for a judgement for 2 months rent and repairs, minus the deposit.

Cost to file today was $126.
