I would add there are F&E exemptions for closely held family businesses that own 1-4 residential (1-4 units each) properties. Don't know about brothers being non-exempt, but it's worth asking a CPA with familiarity with the TN tax code. I'd also just use a TN LLC if you decide to go that route. No reason to pay filing fees in multiple states.

The issue with this is the broker is the one responsible for auditing all the files and they are the ones on the hook with TREC if things aren't done properly.  It's one thing to have good systems in place, but it's another to go through all that info on a semi-regular basis.   So with that said the split can eat into your margins.  I've got my own PM company here in town so happy to discuss if you'd like.

What parts of town are you looking to build in?  I'm actively building homes in Chattanooga and NGA and have been here for the last seven years now.

@Greg Westerfield, Jr., Washington Hills is an ok area.  I don't love it for several reasons.  First, the homes are generally in the 50+-year-old range.  Not terrible but you'll be dealing with things.  Second, while that area is a decent pocket itself (older residents that keep up their homes, on average) it's surrounded by some areas that aren't decent at all.  There are a lot of areas that are gentrifying rapidly downtown and that's pushing a lot of lower-income residents out of that area.  Most seem to be going north to the Hwy 58/Bonny Oaks/North Brainerd areas.  So the question I have is what happens to those areas longer term?  It's not a guarantee that it declines per se but as someone who lived out off 58 for five years, I can say I'm glad I'm not out that way anymore.
