I agree with @Brandt Smith and others above. I would offer $1k "cash for keys". Start with $200 and get ready to pay $1k. Get them out of your property immediately. 

I got burnt and lost about $50k for not doing that. The previous landlord hired an attorney and they delay the case for two years with multiple bankruptcies on the eve of unlawful detainer trial. 

Buying in auction makes it real tough as you may have signed a contract with a gazillion pages. If they were to fight in court they would find something in that contract to drag it.

Your action really depends on how much you know about the previous landlords. Can they afford an attorney? If they find an attorney who is cheaper than the monthly rent then they would drag it as long as they can. I would still sympathize with them for losing the house and pay them $1k. Empathy and Investment - you will win on both counts.

I started investing 6 years ago and have 4 houses in DMV area. I would like to buy and hold the properties. I have a full-time job and real estate is a side business. I am seeking advice/help as to how I can scale from 4 to say 10 houses in next 3 years. I have good credit score and am doing reasonably well. 

Do you all purchase properties from MLS with agents? Are there any other avenues where you look for deals?

I have 4 properties in DMV area. I would like to transfer the ownership from me to my LLC (I am the sole proprietor).

Can someone help me understand the following?

  • What is the process to transfer properties to LLC?
  • Does the type of LLC make a difference?
  • Does having a loan on the property make things complicated?

All I have been trying to do for the past two years is to get possession of the property. I hired attorney and trying to get them out of the property. They are gaming the system legally to negate all my efforts.

BTW previous landlord has a respectable govt. job which pays well.

I purchased a property from homesearch.com with tenants in the property. After settlement I tried convincing previous landlord to vacate the property but no dice. I file "Pay or Quit" notice followed by an unlawful detainer petition in state court. Previous landlord didn't show up  to the court and a default judgement was given. Filed Writ of Possession and Sheriff posted the letter to the door. She hired an attorney to stop the proceeding and they filed an appeal with indigent status.

Fast forward 20 months and they are still living in the property. They filed multiple bankruptcies without following through on every eve of my trial date. The final bankruptcy was followed through successfully. I filed an object for the discharge of debt related to the property. I got Rem Relief from bankruptcy court and waiting for a trial date in state court.

They are anxious to settle now and the offer they have is to vacate the property and leave if I withdraw the case from state court.

Questions:

  • Is there any legal protection for the damages to the property?
  • Is it legally possible to collect the rent for the time they stayed in the property from settlement? There is no contract between the previous landlord and I
