Most exclusive right to sell agreements have a grace period where within a certain amount of time after the listing expires, if an offer is accepted from a buyer who was found while you held the listing, you are entitled to the commission. I would be shocked if your listing agreement didn’t have this provision. Double check, but it seems like a pretty cut and dry breach of contract case.

50/50 is a pretty traditional introductory split for commercial brokerages. Most will have graduated splits. Meaning you start out at 50/50, and the more you earn, the greater percentage of the split you start to collect.

@Shawn Jacobsen I would reach out to the commercial brokerage Marcus and Millichap. Their office is in Salt Lake City, but their agents work all over the region, and they're one of the biggest and best brokerages in the country. They have their own internal "MLS" of sorts for commercial properties, so you'll get national exposure for your listing.

What happens to the security deposit should be outlined in the purchase contract that you made your offer with and both parties agreed to. If they want to make a change a long the lines of what they’re doing, it should be put into an addendum and again, agreed upon in writing by both parties. I’m not an attorney, and Pennsylvania law might be different than where I’m at in Utah, but under Utah law, I’m pretty sure the seller keeping the security deposit on those grounds would constitute a breach of contract. I would go back and read through your purchase contract again and see what it says regarding security deposits.

Are there any Utah investors/agents that have experience dealing with homes that have foundation problems? I'm curious to know what some of the going rates are for repair and if you've noticed whether or not it makes the homes harder to sell afterward?

I can’t speak much to Vegas, but I know the Saint George market is growing and developing pretty rapidly. If I’m not mistaken, it might even be the fastest growing region in Utah. My parents bought a condo there three years ago and it’s already appreciated almost $200k.
