In my experience, it is hard to get a hoarder on board with moving all the stuff. Sometimes they want a clean break. If this is the case, then having him clean the place out so you can list it for 80k doesn’t seem realistic. If you told the guy he could get 80k you did your job imo.

If we continue down this line of thinking, must we make him repair the house so he can get even more than 80k? Would we be at risk of being sued if we don’t make him do that? Where does that line of thinking ever end? Some people value convenience, speed and ease of transaction, privacy, etc...over trying to squeeze every penny out of their house.

How much are the motorcycles worth? Could you sell them to make up the 5k?

Could you take it sub2 to save on closing costs, funding costs etc. while you complete the rehab? Would that be worth 5k? Maybe not, but could be an option.

@John Ala is it a single family house? Brrr on single family is based on refinancing in your personal name. What will having the house in a corporate name do that a good insurance policy won’t?

Mailing to probate is all about timing and your mail piece.

Timing has to be right, that means multiple mailings. I have found that when they are ready to sell, they call the letter they most recently received. Sometimes people hang on to the 50 letters they get and call them, most of the time they trash them until they are ready to sell and then call Mr. Recent Homebuyer that just sent a letter.

I have worked with a lot of “professional” direct mail companies. Most of the time their mail pieces suck, don’t perform well and have to be replaced.

You need to go really personal (hand written, not fake hand written...pay someone or do it yourself) and don’t address the situation, just that you want to buy the house.

Or

Go strictly professional. This is your business, include a logo, business letter look and feel. Address the situation of probate and your are a legit company without feelings but you are aware of the situation and want to buy.

And even better,

Do both periodically until you hear from them.

I strongly recommend that in Texas, you stick with the TREC contract. There is absolutely no legitimate reason to do anything other than that.

To add, correct. just fill it out and use a separate assignment for your end buyer.

@Austin Lee trec contract doesn’t have a non assignable clause. It is considered assignable unless special language is added to make it not assignable.
