When it comes to criminal history, especially something older like a 7–8-year-old felony, I think context is key. To look at the type of offense, how long it’s been, what the applicant has done since, and whether there have been any other issues.

You also want to be consistent and fair. If someone meets all the other qualifications (income, credit, rental history, etc.), and the offense doesn’t directly relate to the safety of the property or others, you could be open to giving them a chance — just like you said with your brother-in-law.

It’s always a good idea to have a written criminal screening policy that outlines what’s reviewed and how far back you look. That way you're protected and staying compliant with Fair Housing guidelines, while still giving qualified applicants a fair shot.

Fellow CA property manager here — I’ve come across this situation a few times. While AB 1482 doesn’t require you to approve a lease change, it’s generally a good idea to consider the request if the new person meets your standard screening criteria. If they qualify, it’s usually in everyone’s best interest to approve the switch and keep things running smoothly.

Since you inherited the lease, it’s worth reviewing it for any specific language about occupant changes. Assuming there’s nothing restricting it, I’d recommend drafting a quick addendum to document the update and have all parties sign.

We allow up to 2 pets max—dogs or cats—with a non-refundable $500 deodorizer fee charged at move-in. We screen all pets through OurPetPolicy, which helps us verify vaccination records and assess risk factors. While we don’t require pet-specific insurance, we do recommend tenants carry renters insurance with liability coverage. This approach has worked well for us while keeping things fair and manageable.

I recommend using platforms like Buildium or Rentec Direct—they handle rent collection, maintenance, accounting, and tenant comms all in one place.
