Hi all,

So during traffic hours we get lots of cars stopping blocking the entrance to our parking lot.  One of (we have a total of 9) tenants complained that it affects his business and asked us to install a sign that says:  Do Not Block Driveway.  I think this is a reasonable request.  However, the way I see it is that there is no way we can enforce it.  We can install the sign and it's still up to drivers out there to read and comply.  Because we are very close to a traffic light and a major highway people have to stop because they have to stop.  I don't see any other retails strips close to us doing this and they are being affected too.  We are not the only one.  Has anyone dealt with this kind of issue?  What did you do?  We are totally within our limit to install such sign if need to and don't need to check with anyone on this, right?

Any advice/tips is greatly appreciated.  Thanks!

Yes, the quote above is only from the Special Provisions section.  I will need to look in the lease too to make sure it doesn't call for a different method of delivery.

 Hi Ron.  For this tenant the lease only said 'If Tenant desires to renew this lease, Tenant must notify Landlord in writing of its intention to renew on or before the date which is at least six (6) months prior to the expriration of the Initial Term of this Lease'.

So I guess in this case an email renewal notice from Tenant is ok?

And it turns out we did sign an amendment with them in which we agreed to extend the lease to next year so I don't have to worry about this now.  But still need to know so I will act accordingly next year.

You can negotiate the terms of the lease on your own, but I suggest having an attorney review/create the lease amendment/extension. Many of the terms may already be dictated by what's in the current lease. Make sure to check that there aren't any extension options within the current lease.  I know from residential side our agent will prepare a lease extension for us and tenants to sign.  On commercial side I am still pretty new and have never renewed a lease before.  From what you said above it sounds like it's the same with commercial lease, that if we have an extension option and if tenants choose to stay and renew then all we need to do is to do a lease extension form?

Having a clearly spelled out clause of responsibilities for repairs and system replacement on the HVAC system can help clear up this issue. This also includes other types of repairs, such as roll up doors, etc. Repair issues have been the main thing that I have gotten calls about from my NNN tenants, so I have my own "lessons learned" on ensuring newer leases are crystal clear.
