You can do it. But why would you go into a transaction with no representation?  It's foolish.

Good luck!  I've never heard of MTM Section 8 (I have two and we are always scrambling for recertifications right up until deadline it feels).  That sounds like the best course of action for you to move the tenant.

Having the tenants sign an estoppel cert is a very wise thing.  Most agents are aware to ask for this for their clients.  You might have some recourse with the brokerage because of the dual agency situation however it'll be hard to prove.  You don't know for sure that the agent purposely withheld the lease.  They may have kept asking for it and they forwarded it to you when they actually finally got it. 

It's an unfortunate situation.  Lessons learned in this business for sure.  Maybe I should share some war stories from the past 20+ years.

A recent episode of the Netflix show called Patriot Act with Hasan Minhaj recently came out and in my personal opinion, perverted the truth when it comes to what so many of us do with real estate investing.  Has anyone watched it and seen how he skewered @James Wise?  Now I know that James' political views lean to the right (which may have made him a target since Hasan is equally to the left).  Still, what Hasan portrayed in the episode if far from the norm.  I get the big corporations running their business like a machine.  Doesn't change the fact that most of us are mom and pop organizations just trying to provide for our families.  Have you seen it?  Have you seen how the supporters of the show are now attacking James' YouTube channel?

This post needs more attention. Hasan clearly cherry picked examples of what he believes real estate investors to be and broadcast that perverted view to the world of far left winged individuals.  I think that @James Wise needs some love from the community on this.  He's not alone on this one.  An attack on one is an attack on all.

If any tenant has said they can't pay due to Covid it's their responsibility to prove the situation.  They just can't claim it and then not pay.  We as owners have to be understanding (and rightfully so if they really have been let go or furloughed), however at the same time their obligation to pay doesn't go away.

For years they never had it.  The other night Montclair enacted rent control on apartments rentals with 5 or more units.  Thank goodness that anything 4 units or less is not covered.  Still, even if they were you're allowed 4.25% annual increases which is more than enough.  And 2.5% on seniors.

Yeah we're at a dead stop in New Jersey now we're the second highest count of Covid cases only to NY.   Only virtual thru 3rd party systems if they're already set up.  We're not even supposed to do live walk thrus as far as I know.
