I’m thinking if they do sign the lease for M2M, won’t they still have to leave the home for renovations because the home will not be habitable due to having no water? Hopefully they’ll accept your offer to stay in a hotel or wherever for two weeks. I think they are not answering your calls because they changed their minds about signing new lease.

I believe you did everything you were required to do and legally. I too get nervous about situations especially since laws seems to be more for the tenant side. If you’re still worried about it, consult an attorney where the first 30 minutes are free. Won’t hurt.

I use a PO Box as a mailing address. I accept check, money order, and the Cash App. My tenants are young so most of my rent payments are through cash app. They seem to prefer this method most and I love it!!!

Don’t sit on these issues. I’m really concerned about the leaks. I would tell the tenant what time I would be there and just go. If they want to be there, it’s their option. Take good before and after pictures /video of everything damaged and document, document. Send them a nice letter 60/90 days notice that you will not be renewing the lease and wish them well.

I was very understanding with the tenant and laid out a very manageable, long term repayment plan and even returned him the keys at one point so that he could have another chance at cleaning/fixing and earn/count the deposit towards his debt.

I was going to tell you to stick it to him so that he’ll be sleeping in his mommy’s basement the rest of his life but @John Chapman’s reply humbled me.

Leave well enough alone. You got your property back and back rented out. Let this be a learning experience. You’ll get the money back over a few years.

I did a two year lease and it was hell!!! Never again!!! Believe me; It’s going to get worse. It’s time for your tenant to go. I would evict immediately. The $50 extra a month you’re receiving in late fees is not worth the headache and sleepless nights. Sounds like you’re running a daycare. I feel your pain.

Maybe have them sign an "Option to Lease", include all the terms of your lease, and the start date.

Then say if he doesn't pay on date X, and take possession on date Y, the option is voided.  Also, refer to the money that he pays you as "Non-Refundable Option Consideration" if he takes possession and begin to pay rent, his NROC is converted into deposit monies (and a lease is signed), if not, it is forfeit.
