Exact thing happened to me and I expect to see more of this. Tenants are scared of a highly competitive market. Some of them become desperate.

California

Eviction for non payment of rent is the only eviction you can be assured you will finally win. All other evictions, plan on the judge giving the tenant 9 lives. (meaning drawn out time and expenses)

Note: Be careful as the new trick the lawyers use is " Harassment".  They can sue the landlord for harassment and join the cases. In this situation the judge will require the harassment claim be closed before the eviction proceeding can continue.  The game here is to get the landlord to settle with a sizable payment made, (which the lawyer will steal most of it)

I am just wondering if the rent payment with a esignature (capture) changes the ability of the tenant to claim " Payment unauthorized". 

Note: Be aware that automated monthly payments increases the risk with this issue. If tenant uses ACH each month for payment, their intent is obvious.  Alternatively, if the system deducts money without monthly user activity it may be harder to fight this claim.

eRent had nothing to do with eCheckit going bankruptand  since then they have changed banks. I believe the only payments that were affected were those made from 10/3 to 10/16 of this year.

Kole, if non sufficient funds is the issue and the time it takes, I believe it takes the same time if you deposit a check for your bank to let you know about a NSF.

 I have a problem tenant. I must ask you this? What makes you believe your tenant will leave at lease end? With my problem tenant they do not respect the  lease. So lease end mean zero to them.

I do not think this is fraud. I know these systems very well and there are reserve requirements and banks have very little trust early on in any relationship. I have spoke with Rick Sands from erentpayment many times and believe he is a honest guy.
