@Gina Mueller This was your primary residence you may have good interest rate. You don't need to refinance unless you want to cash out.

@Praveen Gudimetla All depend how the property is recorded in county record. If its recorded as 2 units, the lender will consider as 2 units.

@Laurie Fiegl Your lender is right you can't cash out because you use other people money to funds the transaction. You have to wait 6 month or try other source to refinance this property.

@Stuart Goodman Are you on title on this property? If yes you have ownership of 50% in this property. If you are not on title you can provide mortgage note to Underwriter showing she has 100% ownership.

@Edwin Rajkumar There is difference in definition for both borrowers but  in you case sister is not going to occupied the the property so above guidelines applies.

@Jack Glazer 25% is minimum requirement for 2-4 units for all borrowers under conventional loan. The guidelines are not different for out of states borrowers.

@Edwin Rajkumar Guidelines from FHA:-

Maximum LTV for Non-Occupying Borrower Transaction

For Non-Occupying Borrower Transactions, the maximum LTV is 75 percent. The LTV can be increased to a maximum of 96.5 percent if the Borrowers are Family Members, provided the transaction does not involve:

 a Family Member selling to a Family Member who will be a non-occupying co-Borrower; or

 a transaction on a two- to four-unit Property.

@Chris Desmond Mostly lender won't combined DPA program and 203K. There is program $100 down payment under FHA which can be comined with 203k program but you have to go in HUD website and keep monitoring those properutes.
