Well, just got a letter from my tenant claiming I am harassing her and to cease and desist. It wasnt an official letter form an attorney but one that looks hand typed. I've barely spoken to this person, so I cant believe they are going this route. Anyone got any tips for this craziness??

@Mary M. Thanks for the advice, yes I've been speaking with and attorney, it all falls under the same covid laws. Its been so frustrating, I still get people wanting to book so its like I know I could still have a chance to come back financially but this person just refuses to leave. At this point I just want to get it back so I can sell it :(

@Ed Zhao Ya, this is really recent so I'm trying to get as much info from the HOA as I can on what she was doing exactly and hopefully use it as a case against her. Its one thing for her and I to have issues but if shes causing problems for the HOA and other residents its way too far.

@David To Yes she has been paying me a discounted rate we agreed on in March. I thought she was only gonna be there a few months so I was fine taking a discount but now its gone on much longer obviously. In her initial letter telling me she refused to leave she never cited being financially impacted by covid, all she said was she was going to follow the stay at home order(this was in June). Shes paid the discounted rate the whole time(which Im glad its at least something). So she definitely violated the lease by not leaving on the agreed date, and then shes refused to sign a new lease so now its month to month. But now that I have the complaint from the HOA saying people are coming in and out I'm quite worried, if shes so afraid of covid why are people coming and going. I've mentioned to my attorney about me moving in, but he seems hesitant to move forward since its very easy for a tenant to claim covid hardship.

I'm in a similar boat where its a month to month and the person was supposed to be out in June. She refused to leave but is not financially impacted by covid. My condo was for an Airbnb so this was never supposed to be a long term lease, shes been there 6 months now. Recently got a complaint from the HOA that multiple people were coming in and out of the unit, I'm hoping this is a breech of lease and my attorney and I can get her out. Thanks everyone for posting updates on whats going on, this thread has been very helpful.

does anyone know if they also extended the forbearance too? it seems like they would go hand in hand here but I cant find any info on the subject. Im really at a loss for word on how this situation is unfolding.

I really hope we can get momentum and do something like this in CA. I havent heard anything yet, waiting on what they decide in the next stimulus package....stay strong guys :(
