I had a leak several months ago, the window cap blew off and I repaired and fixed it.
Now I get a called about 1 week ago and there is a massive leak from somewhere. Either from the other window, or from the tenants ac in the window. Its a old window but no one every complained in the last 10 years. The flooring and sub floor will need to be removed and replaced. They moved out and said the place is unlivable and mold is growing. They reported me to the zoning officer and also filed with there renters insurance claim but it was rejected. I agreed that I will not charge them rent for the time they are not living there. Zoning officer was out and said he did not see any mold and the house was livable just not that room till its fixed. They also did not cut the grass in like 1 month. I am working with my insurance company too and they said dont fix it until a water expert looks at it next week. My tenants said they feel sick from all the mold and mildew after being exposed to it but moved out right away and let all their items.
Tenants now want to be reimbursed for the rent, damage to there items which is nothing, they said their clothes smell like mold, hotel expenses, and reimbursed for financial burden. They want to move back in when its fixed but not sure if mabay I should just be rid of them now to prevent future problems with them.
What would you do? Fix it and let them move back in or try and get rid of them? Should I be charging them rent again soon as its fixed if their not living there? Should I charge them for the grass cutting since it will need to be cut?

I do not think so. That would be called self help eviction I believe its called. If its in the lease they pay for it you could take them to court for it.

I keep the water in my name and forward the bill to the tenant that why I can make sure it gets paid on time. Yes you can put it in their name but if they dont pay it the borough will just put a lien on the property even though the bill is in their name they are technically not responsible for it, its the property owner.

Hi, got another story
Tenant signed 1 year lease with lease auto renew for additional 1 year if tenant does not give 30 day notice. 3 years later I get a text saying they will be moving in 3 to 4 weeks and last month rent can only be used the 11th month of lease expiring and move out. We are 4 month into the 12 month auto renew.
I was nice and let my tenant use last month rent for December and they moved out and gave keys back on the 10th of dec but they also cancelled the utilities. I billed them for the gas bill from dec 11 to 30th before finding a new tenant move in on the 31st. It was $95.
They also broke the lease and moved out and they should have got nothing back but I tried to be nice I gave them $300 back which they did not cash the check yet. security deposit is 965 and last month rent is 965
Is this legal to do to charge my tenant for a utiltiy bill after they canceled it? I had to put it back in my name or ugi would shut off gas and pipes freeze. My lease states my tenant is responsible for the utilities. They now called and are very very mad and screaming at me and then hung up the phone and said they will sue me.
I also feel like putting a stop payment on their refund after trying to be nice.
Just wanted to get your input.

I already replaced the toilet. It is city water and the tenants pay the water bill. I never had this problem with any of my other tenants before at the house. I have a feeling they never cleaned it since the rest of the house was not that clean either.

The toilet was spotless when they moved in about 3 years ago. They moved out and its looks like this. I have tried everything to get these stains out and no luck. Only option is to replace it which I did myself.
Is this concerned normal wear and tear or should I bill them for the toilet? $95.

Yes everything is covered in the lease. I did get first, last, security upfront and its a very good area and very nice house. $965 x 3 upfront.
I wont lose any money unless its vacant until around January 15th. I guess the bottom line is its not my job to inform them and its there job to read the lease we all signed.
Thanks everyone, makes me feel better. I just need to stand firm and tell them to read the lease.

HI everyone. Need some advice here.
Tenant is been there 3 years and was always on time. The lease states It is a 1year lease and will automatically renew if 30 days written notice is not giving at the end of the lease ( Only told them this when we signed the lease and went over everything before signing) I got a text from them few weeks ago, 6 months into the new lease and they said they bought a house and will be moving in a few weeks. I told them I would let them use their last month rent for December. I still have their security deposit. I did a showing a few days ago and the place looks ok. They messed the railing up on the wall and also seen scratch marks on the one cabinet so they must have had a pet. Lease clearly states no pets. Also they cancelled the utilities on 12/10 so I will be stuck with them now. Also they said a scrap person took the lawn mower by mistake I have provided them so Im out a lawn mower to
What should I do? Its going to be vacant till i can find someone but they will be upset if I keep the security deposit also but they did brake the lease several ways.
