This part of the presentation will give attendees a comprehensive overview of the Tenancy Preservation Program (TPP). TPP helps landlords who otherwise would have to evict a renter for behavioral challenges. We will cover:

A few security deposit slides will motivate a help session where you can bring your own security deposit questions and we will do our best to answer them. Or you can attend without any questions just to watch and learn from others.

Security deposits are one of the primary liabilities for Massachusetts landlords. If you make a paperwork mistake, you might owe your renter three times the amount of the deposit plus attorney's fees. And what a lot of paperwork there is! First receipt, second receipt, annual receipt, conditions statement, withholding receipt, signed under the pains and penalties of perjury... Should you even bother?

Well yes, you can successfully take a security deposit. We'll show you how!

We'll be giving an overview of the law and will screenshare some the forms available on our site.

This part of the presentation will be given by Peter Vickery of Bobrowski & Vickery, LLC. Attorney Vickery practices law in Western Massachusetts where he focuses on landlord-tenant law (representing landlords in Housing Court) and discrimination defense (representing business owners in the Massachusetts Commission Against Discrimination). He graduated from Oxford University (Jesus College) with a BA in Modern History; obtained his Post-Graduate Diploma in Law from the University of the West of England in Bristol; his JD from Boston University School of Law; and his Masters in Public Policy & Administration from the University of Massachusetts, Amherst. Attorney Vickery served one term on the Governor's Council (the elected 8-member body that approves or vetoes the governor's choice of judges in Massachusetts) and on the State Ballot Law Commission. As Legislative Affairs Counsel for MassLandlords he drafts bills, bill summaries, and testimony in the area of housing law, and writes amicus briefs in cases that have strategic significance for rental-property owners.

Part I: Tenant Screening Overview

Tenant screening skills are more important than ever in this climate. If you cannot screen adequately, you may be better off leaving your units vacant. We will discuss increasing pass/fail thresholds on written applicant qualifiers, and using such qualifiers before you list a unit to evaluate whether to list at all.

We will then explain how to check credit, criminal, and eviction history. Which sources can we check? What do the reports mean? This segment will review all of these factors, as well as give a comprehensive look at discrimination protections. We'll show you how to protect your assets while also giving equal housing opportunity to all.

Under fair housing in particular, we will cover age discrimination and emotional support animals. Attendees will learn when you can take a photo ID and how to verify requests for reasonable accommodation.

Part II: Rental Applications

The critical step in a tenant screening process is the rental application. Is it complete? Is it true? And is it enough?

In this segment, we will review the general context in which tenant screening happens, covering credit, criminal, and housing history. Then we will review the MassLandlords application box-by-box, with examples completed. Can we verify their prior address? What do their pay stubs look like, or do they have proof of subsidy or other income? Why does it say "etc." under pets? Finally, we'll give guidance on how to communicate acceptance or rejection, and why ghosting an applicant may come back to haunt you.

Attendees will leave with a clear understanding of how to use the MassLandlords rental application, how to verify information presented, and how to rent knowing your new customers are likely to succeed.

Pete is passionate about protecting investments and dreams. He provides comprehensive insurance and risk management solutions based around his clients’ businesses and goals. Pete holds his OSHA 10 Construction certification and is working on his OSHA 10 General Industry certification. Prior to working in the insurance industry, Pete worked in manufacturing, supply chain, and has owned rental properties in Vermont and Western Massachusetts. Pete is a graduate of the University of Massachusetts and a Western Mass native. He lives in Northampton with his wife and two children.

Networking time will be moderated by Patrick Sullivan. Patrick has been an avid landlord since 2007 primarily focusing on multi families in the greater Worcester area. Having worked in high level IT his whole life he looks at things from a different perspective which he applies to real estate. This presentation will give an overview of the federal Fair Housing Act. First passed in April 1968 and since amended, the Titles VIII through IX of the Civil Rights Act of 1968 are commonly known as the Fair Housing Act. This landmark US law prohibits discrimination during the sale, rental, and financing of housing because of someone's membership in a protected class.

We will review the federal protected classes and describe how Massachusetts law builds on and expands these protected classes. We will look at behaviors landlords may engage in that would put us at risk of violating the Fair Housing Act, including:

Declining rental applications without business justification,
Ghosting,
Steering, and
Disparate impact.
In Massachusetts, the Fair Housing Act is enforced by testers looking for discriminatory actions, whether intentional or unintentional. The fine for the first offense is $10,000 and increases for subsequent offenses.

Attendees will leave knowing how to comply with the Fair Housing Act, which aspects of their rental operations may need to be revised, and how to ensure equal housing opportunity for all.

Part of this event will be presented by Attorney Carl W. Lindley, Jr. Attorney Lindley is a partner at Farber and Lindley, LLC. He has been practicing law in Massachusetts for 14 years and is admitted to practice before the United States District Court and United States Court of Appeals for the First Circuit. Attorney Lindley has effectively represented litigants in the District and Superior Courts of Massachusetts, the Massachusetts Appeals Court and Supreme Judicial Court as well as the Juvenile and Housing Court systems. Additionally, he has practiced before many administrative agencies and boards, including the Massachusetts Commission Against Discrimination (MCAD), the U.S. Environmental Protection Agency (EPA), and the Massachusetts Fire Safety Commission and Automatic Sprinkler Appeals Board, among others. Attorney Lindley's practice focuses on civil litigation, including prosecuting and defending serious personal injury, wrongful death, automobile accidents, slip and fall injuries, dog bite cases and professional malpractice claims. Additionally, Attorney Lindley has successfully handled business and landlord-tenant litigation, including housing discrimination, reasonable accommodation issues, lead paint litigation, summary process actions, warranty of habitability and quiet enjoyment claims, lease violations, security deposit claims and class action litigation. He is widely recognized for knowing his stuff: Board of Bar Overseers Pro Bono Panel of Attorneys for 2018 and 2019; named by Super Lawyers as a rising star 2013 through 2015; Chairman of the Board of Directors for Oakham New Braintree Baseball Inc. He teaches a course at Holyoke Community College in Holyoke, MA entitled "Landlord Tenant Law – How to be a Smart Landlord". Attorney Lindley is also a landlord in Worcester County, a licensed real estate broker and licensed to complete moderate risk de-leading on his own properties.

Permanent rental subsidies like the Housing Choice Voucher Program (Section 8) can be great programs to participate in. But they can be tough on the unprepared landlord: your first Section 8 applicant may expose weaknesses in your non-discriminatory tenant screening process, sanitary code compliance, or other aspects of your business!

Attendees will leave with knowledge of the program, confidence in working with Section 8 applicants, and pro tips for navigating the process with flying colors.

SNO Mass:

This part of the presentation will explain Supporting Neighborhood Opportunity in Massachusetts (SNO Mass), a special program for Housing Choice Voucher (Section 8) voucher holders that started in Fall 2020. SNO Mass seeks to address challenges sometimes faced by families and landlords participating in the Section 8 program, with the goal of creating long-lasting tenancies in high-opportunity neighborhoods. We will cover:

How SNO Mass helps families obtain access to good school districts

Which communities are eligible (use the SNO Mass Locator Tool)

Why the program offers two years of support to participants and landlords not available to other Section 8 participants

How much of the move-in monies may be covered

and more!

SNO Mass is interesting for those of us with large units. Typically large units are used in the college market, which turns over frequently. Participating in SNO Mass could lead to longer tenancies, as families want to stay in these high-opportunity neighborhoods. (This is a new program and we don't have a ton of data on turnover yet, but initial results confirm that SNO Mass renters stay longer than the average tenancy of 18 months.) Attendees will leave knowing whether their properties are in a SNO Mass area, why participation is highly desirable, and how to get started.

Part of the SNO Mass presentation will be given by Kristin Haas. Kristin currently serves as the Planning and Implementation Coordinator in the Division of Rental Assistance at the MA Department of Housing & Community Development. In her role, she oversees the Supporting Neighborhood Opportunity in Massachusetts (SNO Mass) housing mobility program. Prior to joining the DHCD team, Kristin worked in the nonprofit sector supporting anti-poverty and homelessness prevention work. Kristin is a board member and former board president of the Community Action Agency of Somerville. She holds a Master’s Degree in Urban and Environmental Policy and Planning from Tufts University and a Bachelor’s Degree in Sociology from Middlebury College.

Part of the SNO Mass presentation will be given by Brendan Goodwin. Brendan currently serves as the Director of the Division of Rental Assistance at the MA Department of Housing & Community Development. In his eleven years at DHCD, Brendan has played leading roles in homeless systems reforms and the design and implementation of homelessness prevention and rehousing programs, the major expansion of state-funded rental voucher programs and a recently launched statewide housing mobility program. He currently oversees state and federal voucher programs serving more than 30,000 households annually. Prior to DHCD, Brendan has held various nonprofit positions mostly focused on housing, homelessness and community development issues. He holds a Master’s Degree in Urban and Environmental Policy and Planning from Tufts University and a BS in Business Administration/Marketing from Xavier University.

The Section 8 presentation will be given by Doug Quattrochi, Executive Director, MassLandlords, Inc. Doug was a founding member of MassLandlords in 2013. He became the association's first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to approximately 2,000 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a staggered and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.

Networking time will be moderated by Patrick Sullivan. Patrick has been an avid landlord since 2007 primarily focusing on multi families in the greater Worcester area. Having worked in high level IT his whole life he looks at things from a different perspective which he applies to real estate. He became a Real Estate agent in 2015 and now primarily focuses on Sober living facilities for people recently out of drug and alcohol treatment centers.

The CDC eviction moratorium has been extended to June 30, despite lawsuits pending in Texas and Ohio. Closer to home, cities like Cambridge and Framingham continue to enforce their own local eviction moratoria. At what point does it end?

At this event, we will review the legal arguments and decisions in the Texas and Ohio cases. We will look anonymously at issues brought to MassLandlords' attention. And we will theorize on the interplay between these moratoria and state and federal subsidy. If the landlord is made whole, is that constitutional? What if the landlord cannot be made whole?

Residents of communities with eviction moratoria in place are welcome to bring their specific concerns. We will not be giving legal advice. This presentation will not create an attorney-client relationship. The purpose of bringing up concerns will be for MassLandlords staff to note your situation and follow-up.

Part of this presentation will be given by Richard D. Vetstein, Esq. Attorney Vetstein is founding partner of Vetstein Law Group, P.C.. He is a nationally recognized real estate attorney and litigator. Recently, Rich was lead counsel in the successful federal legal challenge to the Massachusetts Eviction Moratorium, which received national and statewide publicity. Rich's legal analysis has been quoted in the Boston Globe, Banker & Tradesman, Wall Street Journal's SmartMoney.com, Bloomberg News, and Massachusetts Lawyers Weekly. Mr. Vetstein has also been selected as Metrowest Boston's Best of the Best Lawyers, and one of Inman News' 100 Most Influential in Real Estate. He is the former Co-Chair of the Boston Bar Association's Title & Conveyancing Committee. A dedicated advocate for property owners, Rich was instrumental in the passage of the Act Clearing Title to Foreclosed Properties, and has testified at the State House in support of the Rent Escrow Bill and many other landlord legislative initiatives. An intense advocate, Rich's efforts led to the indictment of a criminal syndicate in one of the largest real estate forgery schemes in Massachusetts history.

Part of this presentation will be given by Attorney Jordana Roubicek Greenman. She is an attorney and a title agent for First American Title Insurance Company and WFG in the Commonwealth of Massachusetts. Attorney Roubicek Greenman has a solo practice with a main office in Watertown and additional office in Downtown Boston. Her practice consists of a broad range of real estate-related legal matters, including commercial and residential landlord/tenant disputes, condominium association representation, general real estate litigation and commercial and residential real estate closings. Attorney Roubicek Greenman has a well-respected reputation for aggressively advocating for her clients' goals and ensuring beneficial outcomes at a reasonable cost. She was among the first attorneys to take legal action in response to the unfunded eviction moratorium.

Networking time for this event may be moderated by Erin Zamarro. (If Erin is not available, Executive Director Doug Quattrochi will moderate.) Erin lives and works in Worcester. Erin is a real estate broker at A.A. Zamarro Realty, an independent brokerage which has operated in the Worcester residential and commercial real estate markets for over 50 years. Our office frequently works with buyers and sellers of investment property. Erin is a Certified Massachusetts Landlord™ as well as a member of the National Association of Realtors. Erin received a B.A. from Holy Cross and an M.B.A with a concentration in Marketing from Clark University.

Mass Save® and associated programs are offering landlords full building insulation, air sealing, and weatherization with generous incentives. All through 2021, for 1-4 unit buildings, "generous" means no-cost (100% covered by the program) for rental units. For landlords with 5 units or more, it will depend but it's still very good. There is no catch: we have already paid for this on our utility bills, in the "Energy Efficiency Chg" line item.

If you previously tried to get insulation and gave up, or have been considering insulation, then this is the presentation for you. Work is being done to streamline the process regardless of the income levels of your renters. For example, a mix of Section 8 and market rate renters in the same building will not stop your plans for greater energy efficiency.

If your building needs and can accept insulation, then you might save thousands of dollars per unit in capital costs covered by the program, depending on your property. Full energy savings accrue to you or your renters, reducing operating expenses, turnover, and/or vacancy costs. Saving up to 30% off your energy bill is possible with attic and wall insulation.

This program follows strict COVID-safe protocols:

Energy audits can be done remotely and jobs can be scheduled in the future.

Wall installation typically does not require entry into units and is performed safely from outside, with full masks and social distancing.

(Depending on your property there may be areas better insulated from inside or only accessible from inside: behind the weather head and electrical meters; brick and aluminum siding; low setback walls. COVID-safe protocols still apply inside.)

Note that buildings must be insulation-ready: knob and tube and other issues will have to be dealt with first.

Additional incentives are possible after the initial energy audit, but are not the focus of this presentation: 0% financing for boilers, heat pumps, etc. This is a presentation about insulation and air sealing, not boilers.
