Rental assistance is available for renters to help pay rent even while the courts remain closed. Residential Assistance for Families in Transition (RAFT) can provide thousands of dollars to families at risk of becoming homeless. Emergency Rental and Mortgage Assistance (ERMA) likewise can provide thousands. Both programs have an application process, an income eligibility screen, and other conditions. Both programs have funding available now. We will cover:
- Who is eligible for RAFT and ERMA? Have eligibility criteria changed recently?
- What can a landlord do to help renters access these funds?
- How much might be available per renter? How much does the state have left to give?
- What conditions are there?
- How long will it take?
- Does accepting RAFT or ERMA prevent me from accessing court in the future? Restrict me in other ways?
- What other programs might I want to be aware of?
Attendees will leave with a step-by-step understanding of how to help a renter apply and how to move the process forward. Wayfinders is a regional subsidy administrator but the information will be broadly applicable to owners and managers statewide.
This part of the presentation will be given by H. John Fisher of Wayfinders. John Fisher has bought, sold and managed rental properties for more than 45 years. He has also worked on and off with Way Finders (formerly HAPHousing) for more than 20 of those years in many roles, including that of a Hearing Officer. John is also the author of the landlord textbook Property Management Manual for Massachusetts Rental Owners, which is now in the fourth printing of its sixth edition.

We'll start this event by reviewing sales data for multifamily and single family buildings by select regions and across the state:

We have an opportunity to solve the housing crisis, guarantee rental housing however long the pandemic lasts, pay every landlord for it, and avoid bankrupting the Commonwealth in the process.
Unfortunately, the Massachusetts legislature seems poised to cancel rents for a year or more, meaning that essentially all rental housing will have to be provided for free indefinitely, until we contain COVID-19 and lift the state of emergency (HD.5166):
"nor shall such rent or use and occupancy payments be recoverable in any proceeding"
Rent cancellation is certain to bankrupt affordable housing providers in droves, who will sell out to condo conversions and never look back. The rent cancellation bill comes with a variety of other proposals including eviction sealing and just cause eviction; landlords have been saying for years that these will further reduce affordable housing supply. We have a consensus alternative:
This webinar will be the public unveiling of our 32 page educational resource and bill text for a “Fair and Equal Housing Guarantee via Surety Bonds.” This is a landscape-changing policy that would guarantee rental housing during the pandemic and simultaneously address the housing crisis:
- Eligible landlords would purchase surety bonds to guarantee full rent for every rental unit affected by COVID-19. In exchange for a guarantee of being paid back, however long it takes, landlords cannot evict for nonpayment.
- The bonds would be paid for and underwritten by the Commonwealth, specifically by a $300 million increase in the Chapter 64 excise tax applied only to deeds for land zoned single family. According to MLS, $27 billion worth of single family deeds were transferred in 2019.
- To avoid the tax, simply convert the single-family zoned lot to multifamily as-of-right.

This presentation will be given by MassLandlords Executive Director Doug Quattrochi, Legislative Affairs Counsel Attorney Peter Vickery, and MassLandlords Helpline Advisor Peter Shapiro.
Doug Quattrochi was a founding member of MassLandlords in 2013. He became the association’s first Executive Director under new bylaws in 2014. Since then, he has scaled the organization from a core of 160 members in Worcester to approximately 1,900 dues paying businesses from Pittsfield to the Cape, and from an all-volunteer team to approximately 20 full and part-time staff plus 50 volunteers. Doug has been instrumental in advancing democratic governance mechanisms, including score voting for policy priorities and a staggered and democratically elected Board of Directors. Doug also oversees the RentHelper spin-off, which is expanding access to electronic banking for those of us who are unbanked or underbanked. Prior to MassLandlords, Doug held leadership roles in various Massachusetts startups, two of which are still operating. Doug holds a Master of Science in Aerospace Engineering from the Massachusetts Institute of Technology.
Peter Vickery of Bobrowski & Vickery, LLC, practices law in Western Massachusetts where he focuses on landlord-tenant law (representing landlords in Housing Court) and discrimination defense (representing business owners in the Massachusetts Commission Against Discrimination). He graduated from Oxford University (Jesus College) with a BA in Modern History; obtained his Post-Graduate Diploma in Law from the University of the West of England in Bristol; his JD from Boston University School of Law; and his Masters in Public Policy & Administration from the University of Massachusetts, Amherst. Attorney Vickery served one term on the Governor's Council (the elected 8-member body that approves or vetoes the governor's choice of judges in Massachusetts) and on the State Ballot Law Commission. As Legislative Affairs Counsel for MassLandlords he drafts bills, bill summaries, and testimony in the area of housing law, and writes amicus briefs in cases that have strategic significance for rental-property owners.
A graduate of MIT’s Master’s Program in City Planning, Peter Shapiro founded and directed Mediation For Results, a Program at Just-A-Start Corporation, a nonprofit in Cambridge, Massachusetts. From 1990 to 2015, Peter and his team provided landlord counseling, mediation and homelessness prevention, and led landlord support groups across Metro Boston. Peter now provides Helpline and Member services for MassLandlords and also provides landlord counseling and mediation for the City of Boston. Peter is the author of: The Good Landlord: A Guide to Making a Profit While Making a Difference.

Rent control is law in Oregon, expanded in New York, and recommended favorably by the Joint Committee on Housing here in Massachusetts. But we tried it in Massachusetts before, and it failed. So why are we still talking about it?
This presentation will review in-depth the three generations of rent control, the history of second generation rent control in Massachusetts, and second and third generation proposals now awaiting floor discussion and further readings. We will review specific bill text. We will examine the reasons advocates want rent control, and the reasons landlords oppose it.
Attendees will leave with an in-depth understanding of why rent control is exactly the wrong direction we should go.

The eviction moratorium enacted at the end of April was scheduled to run until August 18, 2020 unless the Governor extends it, and unless new legislation is enacted that worsens the situation. Even if the moratorium ends as planned, the courts will be different: virtual hearings, long backlogs, and the possibility of further legislation that could change the way we operate. We will try to answer all of the following questions:
- When will the moratorium end?
- What day exactly can I actually serve?
- Are notices served before the moratorium still good? Summons?
- Are executions from before still good?
- What is the case backlog?
- How long will it take the courts to process the backlog?
- What's the earliest jury trial date?
- Are the courts sitting more frequently? Will cases be over zoom or telephone?
- What alternatives do I have besides court?
Attendees will leave with a better understanding of the current policy framework and timelines, and with better ideas to plan for an end to the eviction moratorium.
This part of the presentation will be given by Attorney Jordana Roubicek Greenman. She is an attorney and a title agent for First American Title Insurance Company and WFG in the Commonwealth of Massachusetts. Attorney Roubicek Greenman has a solo practice with a main office in Watertown and additional office in Downtown Boston. Her practice consists of a broad range of real estate-related legal matters, including commercial and residential landlord/tenant disputes, condominium association representation, general real estate litigation and commercial and residential real estate closings. Attorney Roubicek Greenman has a well-respected reputation for aggressively advocating for her clients' goals and ensuring beneficial outcomes at a reasonable cost. She was among the first attorneys to take legal action in response to the unfunded eviction moratorium; her case is before the Superior Court.

We'll be having a round table (really, zoom) discussion about any rental real estate topics. This meeting is a great opportunity for attendees to learn from each other's experiences. Bring your questions about tenant issues, lease agreements and addenda, or best practices. We will be discussing current events, COVID-19, and the eviction moratorium.
Attendees are welcome to share their own experiences, warnings, pearls of wisdom, and more. Participation is not required, you're welcome to come and just listen.
This event will be moderated by volunteers and/or staff with significant and compliant rental experience. The eviction moratorium may have made sense from a public health point of view back in March, but without any funding the same tidal wave of evictions is still coming, only later. At least a year's worth of cases will be filed the week the moratorium ends. And cumulative arrearages the last three months have been 19%, meaning potentially hundreds of millions of dollars would have to be paid to keep every renter out of court. What can be done?
This webinar will review our Fair and Equal Housing Guarantee via Surety Bonds. We will review the basic concept of a housing guarantee, and the key players needed to make it work. Landlords, renters, surety bond companies, and the Commonwealth must all work together. Then we will discuss mechanics of how landlords can get the bond, what they can or cannot do while holding a bond, and how they can get repaid. Finally, we will look at mechanisms for funding surety.
Attendees will leave with a better understanding of the talking points, prepared for advocacy with your representative and senator and others in the community.
This part of the presentation will be given by Peter Vickery of Bobrowski & Vickery, LLC. Attorney Vickery practices law in Western Massachusetts where he focuses on landlord-tenant law (representing landlords in Housing Court) and discrimination defense (representing business owners in the Massachusetts Commission Against Discrimination). He graduated from Oxford University (Jesus College) with a BA in Modern History; obtained his Post-Graduate Diploma in Law from the University of the West of England in Bristol; his JD from Boston University School of Law; and his Masters in Public Policy & Administration from the University of Massachusetts, Amherst. Attorney Vickery served one term on the Governor's Council (the elected 8-member body that approves or vetoes the governor's choice of judges in Massachusetts) and on the State Ballot Law Commission. As Legislative Affairs Counsel for MassLandlords he drafts bills, bill summaries, and testimony in the area of housing law, and writes amicus briefs in cases that have strategic significance for rental-property owners.
