Sarah Stratton Welcome! I also live/invest in Southern California. I have one rental property which I purchased at 24, and just closing on my 2nd, now 27. Wow thank you for that information. The tenant had asked to leave in the next two months (5 months shy of lease), which is another reason for keeping deposit. Since they were late 6 months straight (making payments throughout every month), I replied by making this the final month. That's in reply to your side note However, in reply to your comments that I would have made to anyone else in this situation, which made me chuckle, we stopped driving by the property August of 2013 (due to direct deposit from tenants). Before that, tenants mentioned the Gardner was going once/month. Fired him, hired another, it's Los Angeles :) now I get this :(

Simply put, grass was amazing when I moved out and rented the property, now 1.5yrs later grass is dead. I hired and paid out of pocket for bi-weekly gardener so that this would not happen. I'm currently evicting the tenants for other reasons, so I can't put anymore blame on them since I'm keeping the deposit. Is gardener at fault at all?

Thank you ALL for the great responses. Michelle L , nicely put that is the way I should have interpreted it. This is my first issue with this, as it is my first rental property, and I have heard horror stories with tenants in California. Anyone know where I can go to brush up on landlord-tenants laws?

My tenant has been late on their rent for the past 5 months, never more than 40 days late, which I believe is still bad. When we called them yesterday to ask where the final "installments" for December '13 were, they mentioned we would have it today - January 3, 2014 (which ended up not being true), and still waiting on January's rent. During that same call, they mentioned that they can longer afford to pay rent and want to move out mid March 2014, their lease expires August 2014.

My issue is this, I am getting married early April in Miami, I Live in Los Angeles, so I will be in Miami from late March to mid April, which leaves no time to find another tenant! As if planning a destination wedding is not hard enough as it is, can I ask the tenants to move out mid February instead? Or will that mean that I am breaking the lease? Also, Im assuming I keep the security deposit for breaking the lease? Thank you in advance for any help!!

Hello BP! Just joined up after I came across the forum from a google search for a question and it was thoroughly answered here! Currently have 1 rental property and looking to close soon on my primary residence. I live in the Greater Los Angeles area and my rental property is in SB County. I'm looking forward to gaining knowledge here and also giving as I find ways around roadblocks!
