Post: Tree Branch Fell On Car at Neighboring Property - WWYD?

I had a tree limb fall on a car and create minor damage on the hood (some dents). The tree was on my rental property side and fell on car of the property manager of the apartment building next door (or so she says). She's asking for my insurance info. I did some research online to see who should cover this and found mixed opinions. Some say her insurance, some say mine.

Apparently she put a letter on the tenants door in April notifying that some dead tree branches had been falling, but I was never notified until now.

What would you do here?

South Parker Road Condo 1306 S Parker Rd.
1 bedroom 1 bath 600 sq ft condo that is rent ready. You could take out the wall where the kitchen is and make it an open floor plan so the kitchen flows into the dining room. Other units have done this in the complex which is setting higher ARV's. Has been updated with new laminate floors, kitchen updates, and newer windows. Paint will go a long way in this unit and it is rent ready as is with a little clean up. Looking for a quick close, but flexible.

1.37 Acre Buildable Lot In Erie
This 1.37 acre lot is located near Hwy 52 and County Rd 7 with an Erie address. Lot is Weld County. Has septic, water, and electric on the lot from previous building. The home was demolished and land is now vacant. Potential to divide the lot and build 2 homes on it. This will need to go through USR (special use) or Resub process. From talks with the county, it does sound likely that 2 homes could be built on the land.

Overview:
  • Vacant lot - 1.37 acres
  • Water / Septic / Electric
  • Zoned Ag- potential to divide lot
  • Build 2 or more units
  • Purchase $175k
  • Close Date- June 8th

Does that sound accurate?

Yes. Submits webform, it goes into your Podio system, and you work it from there. If it needs follow ups, put it back on the caller inside podio.

Thank you for the answers everyone.

@Michael Plaks I was told that would be a loan to the company and then I would have to pay that money back.

@Dmitriy Fomichenko You're saying something different than @George Blower. Is it state by state? Still getting varying opinions here..

Hi,

I cannot find any literature from the IRS on whether contributions to a Solo 401k from an LLC taxed as an S Corp have to come from the businesses account or if they can come from a personal checking account. My accountant is saying one thing and my 401k provider is saying another. Anyone have a definitive answer here?

From the accountant:

Both liabilities show up on the corporation’s books and both need to be paid by the corporation. The contributions have to come from the Company because the Company has withheld the $18K from your pay checks and has the fiduciary duty to pay it to the 401K. The employer discretionary contribution has to be made by the employer. The due date for contributions is the due date of the tax return (S Corporation) plus extensions.

From 401K provider:

You can make the contributions from your business or personal checking account as long as the funds stem from self-employment income.

@Juan Lozano Its going to depend on your area. Everywhere is different. Its also going to depend on your mail piece too. Their one card generates a ton of leads, 3% response in my area, which is really really good, but the majority are junk leads. Its the nature of that specific card. Since joining in July I was sending $1500 worth a month for a while and then went to $2500 a few months ago and closed 3 deals from the mail in 2017. My area is super competitive and $2500 is a pretty small budget mail wise. I'm scaling up in 2018, so we will see how results will look then. You can call me if you're on the edge and want more info and specifics.
